jmf 4/18/17 <br />RESOLUTION NO, 2017 -XXX <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA DECLARING SUPPORT FOR THE ORANGE <br />COUNTY FOOD TO FAMILIES — FOOD TO ENERGY <br />ORGANICS RECYLING PROGRAM <br />WHEREAS, the California Integrated Waste Management Act of 1989 (AS 939) <br />mandates that cities and counties reduce the amount of waste disposed in landfills by <br />50% or potentially incur fines of up to $10,000 per day; and <br />WHEREAS, on April 18, 2006, the Orange County Board of Supervisors <br />approved the AS 939 Surcharge on all self - hauled waste to support regional <br />compliance with AS 939; and <br />WHEREAS, Assembly Bill 341 (2011) established an increased solid waste <br />diversion goal of 75 %; and <br />WHEREAS, Assembly Bill 1826 (2014) requires the recycling of organic <br />materials generated at commercial facilities; and <br />WHEREAS, Senate Bill 1383 (2016) establishes targets to reduce landfill <br />disposal of organics by 50% by 2020 and 75% by 2025; and <br />WHEREAS, the County of Orange has released its Fourth Cycle Regional <br />Recycling and Waste Reduction Grant; and <br />WHEREAS, the grant aims to enhance regional partnerships with local cities, <br />special districts, non - profit organizations and private entities; and <br />WHEREAS, the grant opportunity has placed focus on commercial and <br />residential recycling, organics recycling, composting, and education and outreach <br />programs; and <br />WHEREAS, the State has required local municipalities and jurisdictions to <br />develop local markets for diverted and recycled materials; and <br />WHEREAS, the Cities of Irvine, Laguna Beach, Laguna Woods, Mission Viejo, <br />Santa Ana, and the County Unincorporated areas served by Waste Management, Inc. <br />( "Parties ") intend to partner with the Orange County Sanitation District, Waste <br />Management, Inc., and the non - profit Waste Not OC Coalition, a fiscal project of <br />OneOC; and <br />WHEREAS, the City of Santa Ana has joined forces with the Parties to create <br />the Orange County Food to Families -- Food Waste to Energy Organics Diversion <br />Resolution No. 2017 -XXX <br />Page 1 of 3 <br />55C -5 <br />
