one or more of the following body systems: neurological; musculoskeletal; special sense <br />organs; respiratory, including speech organs; cardiovascular; reproductive; digestive; <br />genitourinary; hemic and lymphatic; skin; and endocrine; and (2) any mental or <br />psychological disorder such as a developmental delay, organic brain syndrome, emotional <br />or mental illness, and conditions that cause learning impairments. <br />3.10. Programs, Services, and Activities. The "programs," "services," "benefits," and/or <br />"activities" of a.detention facility include all aspects of the facility's operations that <br />involve detainees. These include, but are not limited to, housing placements, medical <br />care, safety and security protocols, food services, correspondence, visitation, grievance <br />systems, transfers, and detainee programming and scheduled activities such as law and <br />leisure libraries, religious services, educational or vocational classes, work programs, and <br />recreation. <br />3.11. Section 504. Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. § 794), as <br />amended. Section 504 prohibits discrimination based on disability in federally assisted <br />and federally conducted programs or activities in the United States. As used in this <br />Directive, Section 504 applies only to programs or activities conducted by ICE ERO, <br />including through its contractors. <br />3.12. Undue Financial and Administrative Burden. An "undue financial and administrative <br />burden" is a significant difficulty or expense related to a facility's operations, programs, <br />or activities. In evaluating whether a particular accommodation would result in an undue <br />financial and administrative burden, the facility must consider all resources available for <br />use in the funding and operation of the conducted program or activity as a whole. <br />4. Responsibilities. <br />4.1. The Custody Management Division (CMD) has responsibilities under: <br />1) Section 5.7 (ICE Headquarters Oversight and Reporting); and <br />2) Section 6 (Training). <br />4.2. The ERO Disability Access Coordinator (El DAC) has responsibilities under: <br />1) Section 5.1 (ERO Disability Access Coordinator); <br />2) Section 5.4 (FOD Review and Oversight); <br />3) Section 5.5 (ERO HQ Coordinated Review and Response); <br />4) Section 5.6 (ICE Determinations on the Provision of Accommodations); and <br />5) Section 6 (Training). <br />Assessment and Accommodations for Detainees with Disabilities <br />
