The Finance Director shall maintain a detailed accounting .of all expenditures made <br />under this provision and shall submit upon termination of the emergency, a detailed report <br />to the City Manager, who in turn shall provide the report to the City Council. <br />Section 8. Section 2-405 of Chapter 2 of the Santa Ana Municipal Code is <br />amended to read in full as follows: <br />Sec. 2-405. Continuity of Government. <br />Disasters or large-scale emergencies may result in conditions causing the absence <br />or unavailability of officers or officials of the City. The preservation and continued <br />functioning of local government is of utmost concern in these circumstances. The City of <br />Santa Ana will take these minimum precautions to provide for the continuance of essential <br />government services during times of emergencies: <br />A. City Council <br />If, during a Local Emergency, State of Emergency or State of War Emergency that <br />has been proclaimed or exists under the provisions of the Emergency Services Act, it has <br />been determined that a majority of the City Council seats have become temporarily or <br />permanently vacant and a regular quorum no longer exists, the powers and authority of <br />the City Council, except for those duties prescribed to the City Council in Article IV, section <br />403 of the City Charter, shall vest with the Director of Emergency Services until a quorum <br />of the regularly elected City Council Members is present, or until a sufficient number of <br />vacancies that are determined to be permanent are filled under the provisions of Article IV, <br />Section 403 of the City Charter. <br />B. Executive Management Lines of Succession <br />For the purposes of this Division, Department Directors shall appoint a three -deep <br />order of succession of appropriate subordinate management staff to succeed to their <br />position in the event that official is unavailable or unable to serve. The person who <br />succeeds to each office under this provision shall assume all the powers and duties of the <br />office succeeded to immediately upon such succession. The succeeding person shall <br />serve until the appointing official resumes his or her office or until a permanent successor <br />is appointed under the applicable provisions of the City Charter or Municipal Code. <br />Section 9. Section 2-406 of Chapter 2 of the Santa Ana Municipal Code is <br />amended to read in full as follows: <br />Sec. 2-406. Enforcement. <br />It shall be a misdemeanor for any person, during a proclaimed emergency, to: <br />a. Willfully obstruct, hinder or delay any member of the emergency organization in <br />the enforcement of any lawful rule or regulation issued pursuant to this Division, or <br />in the performance of any duty imposed upon him/her by this Division, <br />Ordinance No. NS -2916 <br />Page 11 of 13 <br />
