Resolution No. 2017-01 <br />Page 4 of 5 <br />outcropping, or similar resources, within a highway officially <br />designated as a state scenic highway. <br />The project is located within a residential neighborhood, and no <br />scenic highways are located within this area. <br />4. Hazardous Waste Sites. The project shall not be located on a site <br />which is included on any list compiled pursuant to Section 65962.5 <br />of the Government Code. <br />The Official Hazardous Waste and Substance Site “Cortese” list <br />was consulted and the project site is not included on any known <br />hazardous waste site. This list is updated by the State Department <br />of Toxic Substances and reflects all available information on <br />hazardous sites. <br />5. Historical Resources. The project may not cause substantial <br />adverse change in the significance of a historical resource. <br />The subject property does contain a historic structure known as the <br />“Elliot House” and it is listed on the Santa Ana Register of Historical <br />Properties as a “Landmark” structure. The applicant proposes a five- <br />foot tall fence so that the line of site of the top of the fence matches <br />the two-foot tall balustrade surrounding the terrace surrounding the <br />front façade when viewed from the right-of-way (Exhibit 8) thereby <br />meeting the requirements and objectives of Chapter 13 (Historic <br />Structures) of the Citywide Design Guidelines and the policy of the <br />Historic Resources Commission to maintain a viewshed of the historic <br />residence. This decorative fence provides a formal appearance <br />complementing the appearance of the residence, and would serve to <br />accent the view of the historic property without blocking it because of <br />the slope of the yard. The material and design of the fence are <br />proposed to complement the existing style of architecture while <br />offering the property owner private yard space. <br /> <br /> Section 4. The Zoning Administrator, after conducting the public hearing, hereby <br />approves Minor Exception No. 2017-01 to allow for a five foot tall front yard fence at <br />1904 North Heliotrope Drive. This decision is based upon the evidence submitted at the <br />public hearing, which includes, but is not limited to: the Request for Zoning <br />Administrator action dated May 10, 2017, and exhibits attached thereto; and the public <br />testimony, all of which are incorporated herein by this reference. <br /> <br /> <br /> <br />
