ATTACHMENT <br />• The recognized definition of the term "fair market value" or the equivalent term. <br />• The date of valuation, highest and best use, and applicable zoning of property. <br />• An accurate description of the property to be acquired. <br />• A list of the improvements covered by the offer. <br />• The principal transactions, reproduction or replacement cost analysis, or capitalization <br />analysis, supporting the determination of value. <br />• The amount of the offer. <br />• Where appropriate, the just compensation for the real property acquired and for damages <br />to remaining real property shall be separately stated and shall include the calculations and <br />narrative explanation supporting the compensation, including any offsetting benefits. <br />• An indication that the offer does not reflect any relocation payments or other relocation <br />assistance that you may receive under other regulations. <br />CAN I GET MY OWN APPRAISAL? <br />YES. Pursuant to the California Code of Civil Procedure Section 1263.025 should you elect to <br />obtain an independent appraisal, the City will pay for the actual reasonable costs up to $5,000 <br />subject to the following conditions; <br />• You may order your own independent appraisal. Should you enter into a contract with the <br />selected appraiser, the City will not be a party to the contract. <br />• The selected appraiser you select must be licensed with the California State Office of <br />Real Estate Appraisers (OREA). <br />• At the time the City makes its offer to you, it will offer to pay you the reasonable cost, <br />not to exceed $5,000 of the cost of your independent appraisal. <br />• Appraisal cost reimbursement requests must be made in writing and submitted to the <br />City of Santa Ann, Public Works Agency, 20 Civic Center Plaza M-36, Santa Ana, CA <br />92702, within ninety days of the earliest of the following dates: (1) the date the selected <br />appraiser requests payment from you for the appraisal; or, (2) the date upon which you, <br />or someone on your behalf, remitted full payment to the selected appraiser for the <br />appraisal. Copies of the appraisal contract (if a contract was made), appraisal report, and <br />invoice for completed work by the appraiser must be provided to the City concurrent with <br />submission of the appraisal cost reimbursement request. All appraisal costs must be <br />reasonable and justifiable. <br />MUST I ACCEPT THE CITY'S INITIAL OFFER? <br />NO. You are entitled to present your evidence as to the amount you believe is the value of your <br />property and to make suggestions for changing the terms and conditions of the offer. The City <br />will make reasonable efforts to consider and respond to your evidence and suggestions (including <br />an appraisal). When firlly justified by the available evidence of value, the City may make a <br />revised offer. <br />MAY I HAVE SOMEONE REPRESENT ME DURING NEGOTIATIONS? <br />75F;-38 <br />
