(41) Solid Waste Facility shall include a Composting Facility, Materials Recovery <br />Facility or a transfer station. <br />(42) Source Reduction and Recycling Element shall be the CITY'S plan for meeting <br />the requirements of CIWMA. <br />(43) Waste Type means identified wastes having the features of a group or class of <br />wastes that are distinguishable from any other Waste Type, as identified by the CITY'S Source <br />Reduction and Recycling Element. <br />(44) Yard Waste means any wastes generated from the maintenance or alteration of <br />public, commercial or residential landscapes including, but not limited to, leaves, yard clippings, <br />tree trimming, brush, weeds and pruning. <br />(45) Yard Waste Diversion shall mean the diversion from the waste stream of yard <br />waste or organic waste and the composting, mulching, and/or transformation thereof. <br />4. SCOPE OF SERVICE: <br />(a) CONTRACTOR shall furnish all labor, material, facilities and equipment <br />necessary, except for those vehicles and equipment which the CITY shall license to <br />CONTRACTOR pursuant to Section 11 herein, for the collection of all Solid Waste originating, <br />generated and/or accumulated by any person within CITY boundaries, as they now exist or may <br />hereafter exist, and shall transport, process, Recycle, divert by means of composting, mulching <br />and/or transforming and/or dispose of said Solid Waste in compliance with the terms of this <br />Agreement. <br />(b) All Solid Waste collected by CONTRACTOR within the CITY shall not be <br />commingled in equipment and/or vehicles used by CONTRACTOR, whether such equipment <br />and vehicles are owned by or licensed to CONTRACTOR pursuant to Section 11 herein, with <br />Solid Waste from any other jurisdiction or person from outside the CITY limits; however, in the <br />event of an emergency vehicle breakdown, a vehicle from a neighboring jurisdiction may <br />complete the route of the vehicle which broke down. In this case, the CONTRACTOR must <br />notify the CITY in writing within twenty four (24) hours of such emergency breakdown and <br />must also provide the CITY with the allocation of tonnages contained in the vehicle. <br />5. COLLECTION HOURS: <br />(a) All collections from residential areas shall be made between the hours of 6:00 <br />a.m. and 6:00 p.m. Collections from commercial and industrial locations greater than 100 feet <br />from residential units may start at 3:00 a.m. and must terminate by 9:00 p.m., however, if <br />complaints are received from such residential units, the Executive Director may direct that <br />collections in such areas shall be made between the hours of 6:00 a.m. and 6:00 p.m. and in that <br />event CONTRACTOR agrees to comply with such order. <br />(b) Notwithstanding section (a) above, Solid Waste collected pursuant to Section 13 <br />hereto shall be collected pursuant to the provisions contained therein. <br />6 <br />65B-16 <br />
