4. Update and Recommended Changes to Measure BB—Candida Neal, Planning Manager <br /> and Alvaro Nunez, Code Enforcement Manager, Planning & Building {Strategic Plan <br /> Goal No. 1, lc} <br /> Planning Manager Candida Neal addressed the Council Committee regarding comments made at <br /> the last City Council meeting on May 2nd on how to proceed with Measure BB. Issues were <br /> brought up regarding permitted dispensaries: hours, delivery, signage, testing/R&D, and cash <br /> limits. The Planning Department believes the permitted dispensaries should be treated similar to <br /> other uses as long as there wouldn't be any secondary impacts around surrounding <br /> neighborhoods. These uses are located in industrial areas. In regards to administrative items, <br /> Manager Neal suggests an amendment to the Ordinance to include a revocation process. She <br /> also suggested modifying the Ordinance to allow the sale of the permit to a single owner since <br /> there is nothing in the Ordinance prohibiting someone from buying out the shares of other <br /> owners. Manager Neal asks the Committee to consider whether they want to increase or <br /> decrease the number of medical marijuana collectives allowed. In addition, if the City wants to <br /> expand uses in light of the statute passed in November allowing recreational use. <br /> ACTION: <br /> Chairman Solorio directs Staff to bring Ordinance amendment discussion to the City Council <br /> meeting in June. Bring a list of questions/policy issues to the Public Safety Meeting in July. <br /> Chairman Solorio asks for a special Public Safety meeting in mid-to-late June to discuss <br /> manufacturing/cultivation/distribution. <br /> ACTION: <br /> Chairman Solorio asks the City Manager's Office to consider putting a second City Attorney <br /> position in the budget on the enforcement side and to reach out to Code Enforcement to see if <br /> they need additional personnel. <br /> City Attorney Tamara Bogosian asks Chairman Solorio if he is making a motion for the work- <br /> study session in June. She informs that her office has started preliminary drafts of revising the <br /> Measure BB Ordinance which is articulated in Section 18 of the SAMC. <br /> Chairman Solorio makes a motion to have a study session for Public Safety Committee to <br /> be scheduled for mid-to-late June. <br /> MOTION: Solorio SECOND: Villegas <br /> VOTE: AYES: Villegas, Solorio, Tinajero <br /> NOES: None (0) <br /> Motion carries. <br />
