A-1994-158 12 -ORA -S 31.3/34.6 From 0.2 Mile North of 4th Street to Santa Ana River 12 -ORA -22 10.0/11.0 From the westerly City limit near Bristol Street to Main Street 12 -ORA -57 10.5/10.9 From Route 22 to Route 5 FREEWAY AGREEMENT THIS AGREEMENT, made and entered into on this 2 - day of NoVeyobr�, 1994, by and between the STATE OF CALIFORNIA, acting by and through the Department of Transportation (herein referred to as "STATE"), and the CITY OF SANTA ANA (herein referred to as "CITY"), WITNESSETH; WHEREAS, the State Highway Route 5 described above has been declared to be a freeway by Resolutions of the California Transportation Commission on October 28, 1939, and July 7, 1943; and WHEREAS,. the State Highway Route 22 described above has been declared to be a freeway by Resolutions of the California Transportation Commission on May 18, 1955 and January 23, 1957; and WHEREAS, the State Highway Route 57 described above has been declared to be a freeway by Resolutions of California Transportation Commission on February 15, 1956; and WHEREAS, STATE and CITY have entered into a Freeway Agreement dated February 21, 1989, relating to that portion of Route 5 from 0.2 mile north of 4th Street to the Santa Ana River, Route 22 from the westerly City limit near Bristol Street to Main Street, and Route 57 from Route 22 to Route 5; and WHEREAS, a revised plan map for such freeways has been prepared showing the proposed plan of the STATE as it affects roads of CITY; and WHEREAS, it is the mutual desire of the parties hereto to enter into a new Freeway Agreement in accordance with the revised plan of said freeways;
