Section 8.5 Resolution of Jurisdictional Disputes If any actual or threatened strike, sympathy <br />strike, work stoppage, slow down, picketing, hand -billing or otherwise advising the public that a <br />labor dispute exists, or interference with the progress of Project Work by reason of a <br />jurisdictional dispute or disputes occurs, the Parties shall exhaust the expedited procedures set <br />forth in the Plan, if such procedures are in the plan then currently in effect, or otherwise as in <br />Article 7 above. <br />ARTICLE 9 <br />MANAGEMENT RIGHTS <br />Section 9.1 Contractor and City Rights The Contractors and the City have the sole and <br />exclusive right and authority to oversee and manage construction operations on Project Work <br />without any limitations unless expressly limited or required by a specific provision of this <br />Agreement or an MLAO In addition to the following and other rights of the Contractors <br />enumerated in this Agreement, the Contractors expressly reserve their management rights and all <br />the rights conferred upon them by law. The Contractor's rights include, but are not limited to, the <br />right to: <br />(a) Plan, direct and control operations of all work; <br />(b) Hire, promote, transfer and layoff their own employees, respectively, as deemed <br />appropriate to satisfy work and/or skill requirements; <br />(c) Promulgate and require all employees to observe reasonable job rules and security <br />and safety regulations; <br />(d) Discharge, suspend or discipline their own employees for just cause; <br />(e) Utilize, in accordance with City approval, any work methods, procedures or <br />techniques, and select, use and install any types or kinds of materials, apparatus or equipment, <br />regardless of source of manufacture or construction; assign and schedule work at their discretion; <br />and <br />(f) Assign overtime, determine when it will be worked and the number and identity <br />of employees engaged in such work, subject to such provisions in the applicable Master Labor <br />Agreement (s) requiring such assignments be equalized or otherwise made in a <br />nondiscriminatory manner. <br />Section 9.2 Specific City Rights In addition to the following and other rights of the City <br />enumerated in this Agreement, the City expressly reserves its management rights and all the <br />rights conferred on it by law. The City's rights (and those of the Contract Administrator on its <br />behalf) include but are not limited to the right to: <br />(a) Inspect any construction site or facility to ensure that the Contractor follows the <br />applicable safety and other work requirements; <br />Community Workforce Agreement <br />556-25 City of Santa Ana <br />
