ARTICLE XIV <br />14.0 RELEASE TIME FOR ASSOCIATION REPRESENTATIVE <br />During the term of this MOU, the City agrees to grant fall -tine release from duty for one (1) <br />Association representative for the conduct of Association affairs subject to the following; <br />14.1 The POA Association President cost shall be paid one hundred percent (100%) of salary <br />including any salary additives, such as career incentive pay, confidential premium pay, <br />benefit costs and pension cost. All Association members shall donate one floating holiday <br />annually to city as reimbursement for 100% of the cost of the Association President <br />salary, additives, such as career incentive pay, pension and benefit costs. <br />A. The City shall pay the POA President a "Confidential Premium" in lieu of 20 hours <br />per pay period at time and one-half, This premium is contained in the California <br />Public Employees' Retirement Law (PERL) and is described as "compensation to <br />rank and file employees who are routinely and consistently assigned to sensitive <br />positions requiring trust and discretion." The parties agree that the value of this <br />premium shall be equivalent to 28 hours of pay at straight time per pay period. The <br />rate paid shall be tied to the incumbent's rank. The POA agrees that the acceptance <br />of said compensation as described in section E as "PERSable" is subject to PERS <br />approval and if it is determined that said compensation is not "PERSable" the City <br />is not obligated to provide additional benefits. <br />B. The Police Chief shall allow on -duty time, (up to three days) for five board <br />members, once per year, to attend the Peace Officers' Memorial. The Police Chief <br />shall allow on -duty time (up to four days) for five board members, once per year, <br />to attend the Fraternal Order of Police ("FOP") training. POA will pay for all costs <br />for the board members attendance at said events, including per diem, travel, hotel, <br />etc. If the Memorial or POP falls on a board members normal day off, they will not <br />receive on -duty pay for attendance. <br />C. The City agrees to grant up to a total of sixty hours (60) per fiscal year on a non- <br />cumulative basis to enable the POA members, officers, worksite leaders/stewards, <br />to conduct Union business and assist other bargaining unit employees in processing <br />grievances under the Grievance Review Procedure; provided, however, that such <br />POA members officers, worksite leaders/stewards and aggrieved employees shall <br />make advance arrangement with their supervisors prior to absenting themselves for <br />such purpose. The officers, worksite leaders/stewards and aggrieved employees <br />shall be required by the City to record and report to their supervisors the work time <br />spent in assisting other bargaining unit employees pursuant to this provision of the <br />MOU. <br />14.2 The Association shall provide an insurance policy or policies, or certificate of such <br />insurance, naming the City of Santa Ana, its officers, employees and agents as insured or <br />53 <br />
