The City and Association agree that upon the expiration of this contract and during the <br />good faith negotiations for a subsequent contract, salary and benefits shall continue at the <br />then current rate. <br />ARTICLE XXI <br />21.0 STRIDES AND WORK STOPPAGES <br />21.1 Prohibited Conduct. <br />A. The Association, its officers, agents, representatives, and/or members agree that <br />during the term of this MOU, they will not cause or condone any unlawful strike, <br />walkout, slowdown, sick-out or any other unlawful job action by withholding or <br />refitsing to perform services. <br />B. Any employee who participates in any conduct prohibited in Subsection A above <br />shall be subject to suspension, demotion or dismissal by the appointing authority. <br />C. In addition to any other lawful remedies or disciplinary actions available to the City, <br />if the Association fails, in good faith, to perform all responsibilities listed below in <br />Section 21.2, Association Responsibility, the City may suspend any and all rights <br />and privileges, accorded to the Association in this MOU, including but not limited <br />to suspension of the Grievance Review Procedure and dues deduction. <br />21.2 Association Responsibility. In the event that fire Association, its officers, agents, <br />representatives, or members engage in any of the conduct prohibited in Section 21.IA of <br />this Article, Prohibited Conduct, the Association shall immediately instruct any persons <br />engaging in such conduct that their conduct is in violation of this MOU and unlawful, and <br />they must immediately cease engaging in conduct prohibited in said Section 21.1A, and <br />return to work <br />ARTICLE XXII <br />22,0 LAYOFFS <br />22.1 All layoffs within the competitive service occasioned by abolishment of a position, the <br />combination of duties of two (2) or more positions, or the reduction in numbers of <br />employees in a given class, shall be governed by seniority in the class. Reemployment <br />shall be in reverse order of layoff. <br />22.2 Any promotional probationary employee laid off under these procedures who held <br />permanent status in a lower class shall retain seniority rights in the previously held <br />classification provided that it is still listed in the City's current basic classification and <br />compensation plan. <br />61 <br />
