5. Agree to indemnify and reimburse the City for any court costs and attorney fees that <br />the City may be required to pay as a result of any legal challenge related to this <br />ordinance and/or the City's approval of a Regulatory Safety Permit. The City may, at <br />its sole discretion, participate at its own expense in the defense of any such action, <br />but such participation shall not relieve the operator of its obligation hereunder. <br />Section 40-14. Fees and Taxes <br />All commercial cannabis businesses shall pay applicable fees and taxes, which may <br />include one or more of the following: <br />1. Application Fees. The business owner shall submit a non-refundable fee to cover the <br />cost of processing an application for the commercial cannabis business. These fees <br />may be divided into two fees according to Registration Application (Phase 1) and <br />RSP Application (Phase 2). <br />2. Regulatory Safety Permit Renewal Fees. The business owner shall submit a non- <br />refundable fee to cover the cost of processing an application renewal annually. <br />3. Business License Fee. The business owner shall at all times maintain a current and <br />valid business license and pay all business taxes required by the Santa Ana <br />Municipal Code. <br />4. In -Lieu Agreement Fees. <br />5. Additional cannabis -specific gross receipts, excise, cultivation or any other tax <br />approved by the voters of the City of Santa Ana. <br />6. All required taxes including sales and use taxes, business, payroll etc. <br />Section 5. If any section, subsection, sentence, clause, phrase or portion of this <br />ordinance is for any reason held to be invalid or unconstitutional by the decision of any <br />court of competent jurisdiction, such decision shall not affect the validity of the <br />remaining portions of this ordinance. The City Council of the City of Santa Ana hereby <br />declares that it would have adopted this ordinance and each section, subsection, <br />sentence, clause, phrase or portion thereof irrespective of the fact that any one or more <br />sections, subsections, sentences, clauses, phrases, or portions be declared invalid or <br />unconstitutional. <br />Section 6. The Clerk of the Council shall certify the adoption of this ordinance <br />and shall cause the same to be published as required by law. <br />Ordinance No. NS -XXX <br />Page 26 of 27 <br />75B-32 <br />
