Ordinance Amendment No. 2017-03 — Create Chapter 40 in the Santa Ana Municipal Code <br />(Commercial Cannabis Excepting Medicinal Retail) <br />October 17, 2017 <br />Page 5 <br />(commercial cannabis excepting medicinal retail) to regulate adult use retail and in -door <br />cultivation, distribution, manufacturing and testing of cannabis. <br />NEXT STEPS <br />On November 7th, Staff anticipates bringing forward two items for City Council consideration: (1) <br />the criteria that will be used for the merit based system and how RSP applicants will be <br />evaluated, and (2) a template of an In -lieu fee agreement. Staff will also draft revisions to <br />Measure BB to ensure consistency with new State legislation and a recommendation to increase <br />the gross receipts tax rate from 5%to 6%. <br />STRATEGIC PLAN ALIGNMENT <br />Approval of this item supports the City's efforts to meet Goal #3 - Economic Development, <br />Objective #2 (create new opportunities for business/job growth and encourage private <br />development through new General Plan and Zoning Ordinance policies), Objective #3 (promote a <br />solutions -based customer focus in all efforts to facilitate development and investment in the <br />community), Objective #5 (leverage private investment that results in tax base expansion and job <br />creation citywide); and Goal #4 - City Financial Stability, Objective #3 (achieve a structurally <br />balanced budget with appropriate reserve levels). <br />FISCAL IMPACT <br />Adoption of this ordinance will result in an increase in general fund revenue ranging $9.1 million <br />to $20.25 million dollars per fiscal year. It is recommended that 50% of the new revenue will be <br />dedicated for enforcement efforts and the administration of the program.
