1912, as amended; Title VIII of the Civil Rights Act of 1968, as amended; Department of Justice
<br />Non -Discrimination Regulations, 28 CFR Part 42, Subparts C, D, E, and G; and Department of
<br />Justice regulations on disability discrimination, 28 CFR Part 35 and 39. In the event a Federal or
<br />State court, Federal or State administrative agency, or the Consultant makes a finding of
<br />discrimination after a due process hearing on the grounds of race, color, religion, national origin,
<br />sex, or disability against a recipient of funds, the Consultant will forward a copy of the findings to
<br />CITY which will, in turn, submit the findings to the Office of Civil Rights, Office of Justice
<br />Programs, U.S. Department of Justice. Consultant agrees to the following:
<br />(1) CONSULTANT agrees to comply with Executive Order 11246 which requires that during
<br />the performance of this Agreement, CONSULTANT agrees not to discriminate against any
<br />employee or applicant for employment because of race, religion, sex, color or national origin.
<br />Such action shall include, but not be limited to the following: employment, upgrading,
<br />demotion, or transfer, rates of pay or other forms of compensation, and selection for training,
<br />including apprenticeship. CONSULTANT agrees to post in conspicuous places, available to
<br />employees and applicants for employment, notices to be provided by the CONSULTANT
<br />setting forth the provisions of this nondiscrimination clause.
<br />(2) CONSULTANT agrees to comply with Title VI of the Civil Rights Act of 1964 which
<br />indicates that no person shall, on the ground of race, color or national origin, be excluded from
<br />participation in, be denied the benefits of, or be subject to discrimination under any program
<br />of activity receiving federal financial assistance.
<br />(3) No person shall, on the grounds of race, sex, creed, color, religion, marital status, national
<br />origin, age, sexual orientation, or physical or mental handicap be excluded from participation
<br />in, be refused the benefits of, or otherwise be subject to discrimination in any activities,
<br />programs or employment supported by this Agreement. CONSULTANT is prohibited from
<br />discrimination on the basis of age or with respect to an otherwise qualified handicapped person
<br />as provided for under Section 109 of the Housing and Community Development Act of 1974,
<br />as amended.
<br />(4) CONSULTANT agrees to comply with the Age Discrimination Act of 1975 which requires
<br />that during the performance of this Agreement, CONSULTANT agrees not to discriminate
<br />against any employee or applicant for employment because of age. Stich action shall include,
<br />but not be limited to the following: employment upgrading, demotion, or transfer, rates of pay
<br />or other forms of compensation, and selection for training, including apprenticeship.
<br />CONSULTANT agrees to post in conspicuous places, available to employees and applicants
<br />for employment, notices to be provided by the CONSULTANT setting forth the provisions of
<br />this age discrimination clause.
<br />(5) CONSULTANT agrees to comply with Section 504 of the Rehabilitation Act of 1973
<br />which requires that no otherwise qualified individual with a disability in the United States, shall,
<br />solely by reason of his or her disability, be excluded from the participation in, be denied the
<br />benefits of, or be subjected to discrimination under any program or activity receiving federal
<br />financial assistance or under any program or activity conducted by any executive agency or by the
<br />United States Postal Service.
<br />h. Consultant will comply, and all its contractors will comply, with all
<br />requirements of the Executive Order 11246 of September 24, 1965, entitled "Equal
<br />Employment Opportunity," as amended by Executive Order 11375 of October 13, 1967, and as
<br />supplemented in Department of Labor regulations (41 CFR chapter 60), as applicable.
