Public Hearing — Purchase and Sale Agreement for <br />Property at 830 N. Parton Street <br />October 17, 2017 <br />Page 2 <br />with the Dissolution Act and the California Supreme Court's decision in California Redevelopment <br />Association v. Matosantos, Case No. S194861, the Agency was dissolved and the City began to <br />serve as the "Successor Agency." The City Council serves as the governing body of the Successor <br />Agency under the Dissolution Act as amended by AB 1484, AB 471, and SB 107, to administer the <br />enforceable obligations of the Agency and otherwise unwind the Agency's affairs. All actions of <br />the Successor Agency are subject to the review and approval by the Oversight Board. <br />Health and Safety Code section 34191.5(b) required all successor agencies to prepare a Long <br />Range Property Management Plan (LRPMP) that addresses the disposition and use of all real <br />properties of the former redevelopment agency, and to submit the plan to the California Department <br />of Finance (DOF). The Successor Agency submitted the initial LRPMP on May 26, 2015, and a <br />revised plan was re -submitted on October 4, 2015 with the inclusion of changes as directed by <br />DOF (Exhibit 1). DOF approved the revised LRPMP on December 18, 2015. <br />Among the properties identified in the LRPMP is the property located at 830 N. Parton Street, APN <br />005-142-21. The property is a remnant parcel approximately 3,929 sq. ft. in size in the Professional <br />(P) zoning district (Exhibit 2). This property has been licensed to the adjacent property owner to <br />the north for use as a parking lot since 2003 and the license is currently on a month-to-month basis. <br />The original owners of the adjacent property were Robert C, Politiski and Noreen S. Politiski. <br />Ownership has since transitioned to the Marital Trust of the Politiski Trust dated December 4, 2000. <br />The LRPMP states that the disposition plan for the parking lot is to sell the property, with the <br />proceeds from the sale submitted to the County of Orange, Auditor -Controller for distribution to <br />recipient taxing entities. <br />The Successor Agency obtained a fee simple appraisal for the property on November 10, 2016 and <br />the market value is $155,000 (Exhibit 3). Marianne P. Covington, Ridley J. Politiski and Michael P. <br />Politiski, as Trustees of the Marital Trust of the Politiski Trust dated December 4, 2000 has agreed <br />to pay the appraised value to acquire the property and the purchase will allow them to consolidate <br />the ownership of the entire parking lot on the block. <br />Staff recommends approval of the sale to be in compliance with the Dissolution Act and move <br />forward with the disposition of real property to wind down the Agency's affairs. If approved, the <br />purchase and sale agreement and joint escrow instructions will be submitted to the Oversight Board <br />for approval on October 25, 2017. <br />ENVIRONMENTAL COMPLIANCE <br />In accordance with the California Environmental Quality Act (CEQA), the sale of surplus <br />government property is categorically exempt from CEQA per Section 15312. Categorical <br />Exemption Environmental Review No. 2017-125 will be filed for this project. <br />SA4-2 <br />
