(d) The Contractor is responsible for visually inspecting recyclable solid waste <br />containers and organic materials containers as necessary to determine whether the content is <br />contaminated with non -recyclable solid waste. The recyclable solid waste container shall be <br />considered contaminated if it contains more than 10% non -recyclable solid waste or 10% yard <br />waste, individually or combined, in the recyclable solid waste container, or more than 10% non- <br />organic materials in the organic material container. <br />The CONTRACTOR shall follow the procedures listed below for addressing <br />excessively contaminated recyclable solid waste containers or organic material containers as well <br />as providing written documentation prior to assessing any fees to Customers. <br />(1) Residential Customers <br />I" and 2nd instance: The CONTRACTOR shall take photograph(s) of cart content, <br />collect the material from the cart, leave a courtesy notice approved by the City that explains why <br />the material collected was non -conforming, and notify the City. The written notice shall also <br />explain the policy for non -conforming materials, recommend corrective action, and explain the <br />consequences for repeated instances. <br />3'd instance and subsequent instances: The CONTRACTOR shall have the option <br />of charging a Contamination fee not exceeding the Maximum Service Rate for such service set <br />forth in Exhibit C, or follow the non -collection procedure in Section 13 (c). <br />(2) Commercial Customers <br />lei instance: The CONTRACTOR shall take photograph(s) of container content, <br />collect the material from the container, provide a courtesy notice that explains why the material <br />collected was non -conforming, and notify the City. The written notice shall also explain the <br />policy for non -conforming materials, recommend corrective action, and explain the <br />consequences for repeated instances. <br />2,d instance and subsequent instances: The CONTRACTOR shall have the option <br />of charging a Contamination fee not exceeding the Maximum Service Rate for such service set <br />forth in Exhibit C, or follow the non -collection procedure in Section 13 (c). <br />(3) Each written notification and photograph(s) shall be transmitted to the <br />City. The second or third instances, shall be counted as such if they occur within twelve (12) <br />calendar months of the initial instance of each Non -Conforming type. If twelve (12) calendar <br />months have elapsed since any Cart was tagged for the same reason, the next instance shall be <br />deemed the initial instance. If the CUSTOMER has changed; and the account is new, with <br />different occupants, the written notification shall be considered the initial instance. <br />25Fz-21 <br />
