(6) CONTRACTOR may require as a condition of walk -out service that a <br />Customer sign a standardized agreement, the terms of which shall be subject to City's approval, <br />which authorizes entry onto the Curbside Service Unit serviced under Customer's account and <br />holds CONTRACTOR harmless from liability (including specifically liability related to pets <br />escaping) associated with CONTRACTOR providing such service. <br />(b) ORGANIC MATERIALS SERVICES (AB 1826 COMPLIANCE): <br />CONTRACTOR shall provide all the necessary services to maintain compliance with the <br />requirements of AB 1826, including but not limited to, identification of businesses that are <br />subject to the requirements of the law according to the applicable thresholds; an outreach <br />campaign to inform businesses concerning the requirements of the law; fielding calls from <br />customers who are inquiring about organic materials recycling regulations and how it might <br />apply to them; source -separated organic materials collection service; and, monitoring and <br />reporting on organic materials recycling activities to identify businesses not recycling and to <br />inform them of the law and how to recycle organics. <br />(1) CONTRACTOR shall offer to collect organic materials on a subscription <br />basis at a rate not exceeding the Maximum Service Rate for such service set forth in Exhibit C. <br />CONTRACTOR shall, subject to the limitations set forth in Article 9, provide this service to all <br />commercial establishments requesting such service. <br />(2) CONTRACTOR shall provide wheeled carts and bins for collection of <br />Organic Material. Customers will have the opportunity to subscribe to the appropriate service <br />level. 64 -gallon carts and 2 cubic yard bins will be made available. Collection frequency will be <br />at least once (1) per week and up to seven (7) times per week. Customers and Contractor will <br />determine a mutually acceptable collection location. <br />(3) CONTRACTOR shall deliver all collected organic material to a fully <br />permitted organic material processing facility or a fully permitted organic material transfer <br />station. CONTRACTOR shall ensure that all organic material collected pursuant to this <br />Agreement is diverted from the landfill in accordance with the Act and any subsequent or other <br />applicable legislation and regulations. CONTRACTOR shall ensure that the organic material <br />collected pursuant to this Agreement is not disposed of in a landfill, except as a Residue resulting <br />from processing. CONTRACTOR must provide end uses for organic material that maximizes <br />diversion credits for CITY according to regulations established by CalRecycle. <br />(c) BIN SERVICE: CONTRACTOR shall operate a Recycling program as described <br />herein for Bin Service. Such Recycling program shall require that CONTRACTOR take the <br />Solid Waste in bins which have clean "dry" loads to a MRF which is acceptable to the CITY for <br />Processing and diversion. CONTRACTOR shall guarantee that, at a minimum, fifty (50%) <br />percent of the tonnage of Solid Waste which is contained in bins and which is determined to <br />have a high recyclable content will be transported to a MRF. All Solid Waste which is <br />transported to said MRF shall be processed and the portion thereof which is recyclable shall be <br />recycled by Waste Type in amounts so as to comply with CIWMA and the CITY'S SRRE.
