mgt. �[ S <br /> 4A-2001-179 <br /> :2i RsjF�ae1, <br /> L'13-JAIAL AGREEMENT BETWEEN THE CITY OF SANTA ANA <br /> fb'rr. /b— I -4 en AND THE ORANGE COUNTY CONSERVATION CORPS <br /> THIS AGREEMENT, made and entered into this Tth day of September 2001 by and <br /> between the Orange County Conservation Corps, a California non-profit corporation (hereinafter <br /> "OCCC"), and the City of Santa Ana, a charter city and municipal corporation duly organized <br /> and existing under the Constitution and laws of the State of California (hereinafter"CITY"). <br /> RECITALS <br /> `9 A. The CITY desires to assist in the development of a local conservation corps to help "at <br /> ;%115' risk" youth acquire career skills and work experience, while continuing their education, <br /> a� thereby addressing problems with gangs and illicit drugs; and <br /> ;GNt B. CITY needs assistance in the removal and re-landscaping along Santiago Creek, which <br /> ' can be performed by OCCC; and <br /> C. OCCC is ready, willing and able to supply persons between 17-25 years of age to train <br /> and perform certain services for the CITY under the terms and conditions set forth <br /> herein. <br /> NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br /> terms and conditions hereinafter set forth, the parties agree as follows: <br /> 1. SCOPE OF SERVICES <br /> OCCC shall provide labor, supervision, adequate crew to complete the project, tools, <br /> crew equipment, and corps members' safety items to perform those tasks requested by the <br /> Executive Director of Parks, Recreation and Community Services Agency, and/or his/her <br /> designee ("Director"), which OCCC is able to perform. The Project will include the removal and <br /> re-landscaping along Santiago Creek from Santiago Bridge to the 22 Freeway. The assignments <br /> contemplated herein include, but are not limited to, re-contouring the banks and slopes of <br /> Santiago Creek with hand tools, removal of exotic vegetation, and planting of native vegetation. <br /> Additionally, OCCC shall be involved in two half-day training workshops. <br /> 2. COMPENSATION <br /> a. City agrees to pay, and OCCC agrees that the total sum to be expended under this <br /> Agreement shall not exceed Forty Five Thousand Dollars ($45,000.00) during the term of this <br /> Agreement. The hourly cost for services to be provided by OCCC members shall be Eighteen <br /> Dollars and Five Cents ($18.05). <br /> b. Payment by City shall be made within thirty(30) days following receipt of proper <br /> invoice evidencing hours and work performed, subject to City accounting procedures. Payment <br /> need not be made for work failing to meet the standards of performance reasonably expected by <br /> City. <br /> 1 <br />
