SA TP O MOBILE DATA COMPUTERS FOR THE SANTA ANA POLICE DEPARTMENT L{.o Mrr v,a° " THIS AMENDMENT to the above -referenced agreement is entered into on October 4, 2017, by and between CDCE, Inc., a California corporation ("Consultant"), and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California ("City"). RECITALS A. The parties entered into Agreement #A-2016-361, on December 6, 2016 ("Agreement"). The Agreement was approved by the City Council. Consultant agreed to provide services related to the installation and maintenance of mobile data computers ("MDC"), and their related equipment used by the Santa Ana Police Department, B. The parties entered into an Addendum to the Agreement (#A-2016-361-01) detailing the exchange of equipment for these services, with only a nominal cost to cover freight charges for the exchange. C. Per Section 2.a. of the Agreement, City and Consultant, included $75,000 in contingency funds to be utilized at the City's discretion to cover additional costs for these services. To date, none of the contingency monies set aside, and approved by the City Council, has been spent in regards to this Agreement or the Addendum. All costs for the services under this Amendment shall be covered by the Contingency Funds. Any additional funds required to cover costs, not funded by the Agreement, shall be subject to an additional amendment to the Agreement and require approval by the City Council. C. The parties wish to amend the Agreement to include additional services to install and maintain equipment for the Police Department's motorcycles not originally included as part of the Agreement but for equipment and services related to the scope of the RFP detailed in the Agreement. City agrees to comply with any requests for information as to the installation under Exhibit B to the Agreement. Consultant agrees that the equipment, and related services, are subject to the installation and warranties detailed in Exhibits B and C of the Agreement. The Parties therefore agree: 1. Section In, Scope of Services, shall be amended to read as follows: a. Consultant shall provide MDCs and equipment as specified in Exhibit A and Exhibit A-1, identified as Quote #110357, attached hereto and incorporated by reference. Page 1 of 2
