Bristol Street <br />November 21, 2017 <br />Page 2 <br />draft site plan that will triple the drive-through stacking capacity and meet the site vehicular <br />demands. <br />DISCUSSION <br />During the course of the Bristol Street Improvements Project, the Public Works Agency has <br />acquired numerous properties along the corridor. The subject properties were acquired as part of <br />Bristol Street Improvements Phase 3A (Exhibit 1), the segment bounded by Civic Center Drive <br />and Washington Avenue. The purchase prices of the three properties acquired by the City were <br />based on appraised values prepared by a state licensed appraiser. The portions of these <br />properties that will remain after the Bristol Street Improvements Project is completed, and which <br />will not be used by the project, are being held for purposes of exchange or sale. In -N -Out <br />Burgers has agreed to acquire these properties for the appraised amount of $905,000. <br />Sale of City Owned Parcels — Legal Authority <br />Under the Santa Ana Municipal Code (SAMC) Section 2-706, surplus real property may be sold <br />(after authorization by the Council) only to the highest bidder, subject to final confirmation by the <br />Council and with notice of the sale given by newspaper publication. SAMC Section 2-709, <br />however, provides an exemption to this procedure and permits a sale on direct negotiation <br />without the need for public auction or competitive bidding, upon 2/3 vote of the City Council after <br />a duly noticed public hearing. <br />On November 7, 2017, the City Council held the required public hearing and authorized the <br />negotiation for the sale of the real property. Staff recommends approval of the Purchase and <br />Sale Agreement with In -N -Out Burgers to ensure that the current traffic issues are mitigated as <br />well as businesses and residents' complaints are addressed. <br />STRATEGIC PLAN ALIGNMENT <br />Approval of this item supports the City's effor <br />Infrastructure, Objective #1 (establish and mair <br />assets), Strategy G (develop and implement <br />coordination with the Community Investment and <br />s to meet Goal #6 — Community Facilities & <br />Iain a Community Investment Plan for all City <br />the City's Capital Improvement Program in <br />Deferred Maintenance Plans). <br />Approval of this item also supports the City's efforts to meet Goal #3 — Economic Development, <br />Objective #2 (create new opportunities for business/job growth and <br />development through new General Plan and Zoning Ordinance policies), <br />business development and job growth along transit corridors through the <br />transit plans/projects). <br />ENVIRONMENTAL IMPACT <br />There is no environmental impact associated with this action. <br />20B-2 <br />encourage private <br />Strategy C (support <br />completion of critical <br />
