REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />NOVEMBER 21, 2017 <br />CLERK OF COUNCIL USE ONLY: <br />TITLE: <br />APPROVED <br />RESOLUTION TO ACCELERATE <br />❑ As Recommended <br />RELINQUISHMENT OF CALTRANS LOCAL <br />❑ As Amended <br />STREET RIGHT-OF-WAY TO CITY <br />❑ Ordinance on nd Rea Reading <br />2 <br />❑ Ordinance on 2 Reading <br />{STRATEGIC PLAN NO. 6 1 <br />, G } <br />❑Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />CITY NAGER <br />Adopt a resolution waiving the 90 -day written notice requirement prior to Caltrans' relinquishing street <br />right-of-way to the City. <br />In 1989, the City Council adopted a resolution approving a freeway agreement with Caltrans to widen the <br />I-5 Freeway. The agreement stipulated that, for any newly created or realigned local streets, the City <br />would assume maintenance responsibilities upon construction completion, and would accept title <br />ownership upon relinquishment by Caltrans. <br />The 1-5 Freeway widening project was completed in the mid-1990s and Caltrans now wishes to delete <br />these local streets from the State Highway System (Exhibit 1). Under the provisions of the Streets and <br />Highways Code, the State is required to notify any City to whom it intends to relinquish a State highway at <br />least 90 days prior to recordation of such relinquishment. Since these streets are in good condition and <br />because the improvements have been in local use since the project completion, there is no need for the <br />additional 90 -day delay. Therefore, City staff recommends waiving the 90 -day notice requirement. <br />One of the identified relinquishment site would allow for the development of a proposed hotel on Main <br />Street and the 5 Freeway. <br />STRATEGIC PLAN ALIGNMENT <br />Approval of this item supports the City's efforts to meet Goal #6 — Community Facilities & Infrastructure, <br />Objective #1 (establish and maintain a Community Investment Plan for all City assets), Strategy G <br />(develop and implement the City's Capital Improvement Program in coordination with the Community <br />Investment and Deferred Maintenance Plans). <br />ENVIRONMENTAL IMPACT <br />There is no environmental impact associated with this action. <br />5513-1 <br />
