SURANCE NOT, REQ010 <br />VjORK naav caknt� g <br />tyly�ii;�t <br />RIP NX 2 0 2017 <br />O: <br />Gabrii <br />N-2017-242 <br />Downtown Restroom Artwork Pro <br />City of <br />ARTIST AGREEMENT <br />This agreement is made and entered into this 10th day of <br />2017, by and between the City of Santa Ana, a charter <br />municipal corporation (hereinafter "City"), and Brian Peterson (hereinafter <br />selected to create artwork for the Downtown Restroom Artwork Project. <br />October, <br />city and <br />"Artist") <br />In consideration of the promises contained herein, the receipt and adequacy of which is <br />hereby acknowledged, the parties hereto agree as follows: <br />A. Project <br />Artist will create (2) piece(s) of artwork to submit to the City. The title(s) of the <br />artwork are attached as Exhibit A to this Agreement, and incorporated herein by <br />this reference. <br />2. Artist will not be required to physically paint, alter or provide any form of creative <br />work to the location site for the Project. Work provided by the artist will be <br />created at the artist's location or studio. <br />3. All work will be submitted to the City in a digital format, including but not limited <br />to, size of file, resolution, image file format (i.e..png, .jpeg, .tif, .gif, etc.), as <br />requested by the City at the time of assignment. The work will be due within (3) <br />week(s) of the start of the assignment. <br />4. City will receive the digital work and assign a third party vendor to transfer the <br />image to a vinyl wrap. The final version of the completed vinyl wrap may be <br />subject to slight revisions to meet vendor specifications with respect to image <br />quality. The vinyl wrap will be installed, maintained, repaired and removed by the <br />City. <br />5. Artist recognition via signature on the work may be no larger than 3" x 5". <br />6. Subject to the sole interpretation of the City, artwork may not contain advertising, <br />religious art, sexual content, negative or violent imagery, convey political <br />partisanship or include any hidden, subliminal or camouflaged messages or <br />statements of any kind or nature. <br />Artwork may not include any breach of intellectual property, trademarks, brands, <br />or images of illegal activity. <br />
