Councilmember Tinajero, concerned with possible violation of Code of Ethics; <br />noted that incoming City Manager was vetted through process dictated by the <br />City — democratic process. <br />Mayor Pro Tem Martinez, commented that City Council need to conduct the <br />people's business and avoid politizing decisions, follow Charter; all members <br />respect decisions of the council majority. <br />Councilmember Solorio, proposed substitute motion to approve policy that <br />would allow Mayor Pro Tem or designee to execute this and any future <br />contracts; noted that he was opposed to total contract amount. <br />City Attorney Carvalho, indicated that Charter includes authority in the case of <br />an absence, but no provision when Mayor present and dissented; referenced <br />2015 Case Law that may apply in this matter. <br />MOTION: Direct and authorize the Mayor Pro Tem and the Clerk of the <br />Council to execute the attached agreement appointing Raul Godinez as <br />the City Manager for the City of Santa Ana (AGMT.
