jmf 10/24/17 <br />RESOLUTION NO. 2017-069 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA WAIVING THE STATUTORY NOTICE BY THE <br />STATE OF CALIFORNIA OF ITS INTENT TO RELINQUISH <br />CERTAIN PARCELS ALONG STATE HIGHWAY ROUTE 5 <br />LOCATED WITHIN CITY LIMITS <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines and <br />declares as follows: <br />A. At various times, the State of California Department of Transportation <br />("State") has acquired title to certain segments of land abutting State Highway <br />Route 5 to complete highway projects. <br />B. The State wishes to relinquish its title to certain of these segments located <br />within the City. These segments are depicted as segments 1 through 10 on <br />Exhibit A, as attached and incorporated by reference. Upon relinquishment, all <br />right, title, and interest in these parcels shall vest in the City. <br />C. The parcels are in a state of good repair. <br />D. Under Section 73 of the California Streets and Highways Code, prior to <br />relinquishing any portion of a state highway to a county or a city, the State is <br />required to give 90 days' notice in writing of its intention to relinquish to the board <br />of supervisors, or the city council, as the case may be. <br />E. The City of Santa Ana and the State have met regarding the relinquishment of <br />the parcels in question and determined that the 90 -day notice requirement will <br />prolong the process of relinquishment without benefit to the City or the State. <br />Section 2. The City Council of the City of Santa Ana hereby waives its right to <br />receive 90 days' written notice by the State of the State's intent to relinquish segments 1 <br />through 10 depicted in Exhibit A. <br />Section 3. This Resolution shall take effect immediately upon its adoption by <br />the City Council, and the Clerk of the Council shall attest to and certify the vote adopting <br />this Resolution. <br />Resolution No. 2017-069 <br />Page 1 of 6 <br />
