H. Denial. No employee shall be entitled to sick leave with pay while absent from <br />ditty because of sickness or injury purposely self-inflicted or caused by willful <br />misconduct; or because of sickness or injury sustained while engaged in <br />employment, other than employment by the City, for monetary gain or other <br />compensation; or due to other reasons resulting from engaging in any business or <br />activity for the purpose of personal monetary gain or other compensation. <br />I. Excess Usage. If sick leave is used in excess of that due and available, such excess <br />sick leave will first be deducted from any available compensatory time off benefit, <br />then from any available vacation leave benefit, and finally from the next scheduled <br />salary payment. <br />J. Necessity Leave. Each employee shall be afforded the opportunity to use up to 48 <br />hours of sick leave per calendar year, on a non -cumulative basis, as personal <br />necessity leave. Personal necessity leave may be used to attend to an illness of a <br />family member. <br />"Family member" means any of the following: <br />(1) A child, which for purposes of this article means a biological, adopted, or <br />foster child, stepchild, legal ward, or a child to whom the employee stands in loco <br />parentis. This definition of a child is applicable regardless of age or dependency <br />status. <br />(2) A biological, adoptive, or foster parent, stepparent, or legal guardian of an <br />employee or the employee's spouse or registered domestic partner, or a person <br />who stood in loco parentis when the employee was a minor child. <br />(3) A spouse. <br />(4) A registered domestic partner. <br />(5) A grandparent. <br />(6) A grandchild. <br />(7) A sibling. <br />Any member of the employees' household related by blood or marriage; any other <br />relative of the employee by blood or marriage, where it can be established by the <br />employee that the employee's presence is required to handle emergency <br />arrangements and/or other matters. <br />Necessity leave may also be used: a) to attend to a serious accident to members of <br />the employee's immediate family; b) childbirth; c) to cope with imminent danger <br />to the employee's family, home, or other valuable property; d) when the existence <br />of external circumstances beyond the employee's control make it impossible for <br />him or her to report for duty; or e) attend to medical or dental appointments for <br />members of the employee's household or family member as defined above. <br />42 <br />25B-44 <br />
