RFP to not allow City Council to communicate with vendors, and opined City <br />Council should have all information available to make an informed decision. <br />n <br />Councilmember Solorio, asked when final Request for Proposal will be <br />presented to City Council. <br />Executive Director of Public Works Mousavipour, noted provision would <br />eliminate potential unfair advantage and to create a single source of <br />information for everyone to access. <br />Joe Sloan on behalf of Sloan, Vazquez, McAfee noted provision is at the <br />discretion of the City Council and recommends adoption of ex parte <br />communication restriction. <br />City Attorney Carvalho, opined proposed provision is the best practice of <br />this kind due to the size and nature of the contract, noted provision is <br />intended to protect City Council, and reviewed alternative ways to be <br />involved while being protected. <br />Councilmember Tinajero, expressed desire to perform due diligence and be <br />prepared when RFP is presented to City Council. <br />Mayor Pro Tem Martinez, noted City of Santa Ana has other waste haulers <br />that should be offered the same contract extension. Noted inconsistent <br />timeline in presentation and Request for Council Action and recommended <br />removal of provision to not allow City Council to communicate with vendors. <br />Councilmember Solorio, requested a memo to address compliance and <br />possible issues with Proposition 218 prior to final RFP, and community <br />outreach to ascertain community waste needs. <br />City Attorney Carvalho, commented on possible alternatives to Proposition <br />218 process. <br />City Manager Godinez, confirmed community outreach would impact <br />timeline schedule and potential Prop 218 policy review. <br />FRIENDLYAMENDED MOTION. <br />Authorize the City Manager and the Clerk of the Council to <br />execute the proposed Extension of the Fourth Amended and <br />Restated Agreement for Collection and Handling of Solid Waste <br />with Waste Management Collection and Recycling, Inc.
