REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />DECEMBER 19, 2017 <br />TITLE: <br />APPROVAL OF AGREEMENT WITH <br />LIEBERT, CASSIDY WHITMORE FOR <br />SPECIAL LEGAL COUNSEL <br />{STRATEGIC PLAN NO.7; 4,6 & 71 <br />CIT ANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on I" Reading <br />❑ Ordinance on 2nd Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Authorize the City Manager and Clerk `of the Council to execute a Professional Services <br />Agreement with Liebert Cassidy Whitmore for negotiation services with the City labor unions for <br />the period of January 1, 2018 through December 31, 2018 in the amount of $75,000, subject to <br />non -substantive changes approved by the City Manager and City Attorney. <br />DISCUSSION <br />The City has entered into legal services agreements with Liebert, Cassidy Whitmore for labor <br />negotiation assistance. The labor agreements with the Part Time-SEIU employee association <br />has expired and the contracts for both POA, SAPMA will expire in June and it is anticipated that <br />the City will be starting negotiations with all groups shortly after the start of the calendar year. <br />Staff conducted a RFP process and received three responses. The firms were evaluated by <br />staff. Based on expertise and a competitive pricing structure staff is recommending the firm of <br />Liebert Cassidy Whitmore. Liebert Cassidy and Whitmore is a California law firm, specializing in <br />labor and employment law. The City of Santa Ana has contracted with the firm in the past to <br />assist and advise on various personnel and labor law matters. Based on the ongoing working <br />relationship between the City and firm, staff is recommending continued utilization of Liebert <br />Cassidy Whitmore's services. The firm has extensive experience working with public sector <br />clientele throughout the state and has a staff of over 40 partners and associates in the Los <br />Angeles office. <br />The proposed Agreement is for a term of one year and for an amount not to exceed $75,000. <br />STRATEGIC PLAN ALIGNMENT <br />Approval of this item supports the City's effort to meet Goal #7 — Team Santa Ana, Objective #4, <br />Establish employee compensation that attracts and retains a highly qualified workforce, objective <br />25L-1 <br />
