ROH -12/19/17 <br />RESOLUTION NO. 2017-089 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA LEVYING AN ASSESSMENT FOR THE <br />DOWNTOWN SANTA ANA BUSINESS IMPROVEMENT <br />DISTRICT FOR CALENDAR YEAR 2018 <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. On February 6, 1984, the City Council, by Ordinance No. NS -1715, established <br />the Downtown Santa Ana Business Improvement Area pursuant to California <br />Streets and Highways Code Sections 36500, et seq. (the 'BID Law"). <br />B. On November 21, 2017, the City Council received the 2017 Annual Report for <br />the Downtown Santa Ana Business Improvement District (the 'Report'). <br />C. On November 21, 2017, the City Council adopted Resolution 2017-067 <br />approving the Report and setting a public hearing for December 19, 2017, at which <br />time protests could be made to the proposed levy of the 2018 annual assessment <br />for the Downtown Santa Ana Business Improvement District (the "Annual <br />Assessment'). <br />D. On December 19, 2017, at the time and place called for in Resolution 2017- <br />067, the City Council conducted a duly noticed public hearing at which written and <br />oral protests to the proposed Annual Assessment were made and considered as <br />provided in Streets and Highways Code section 36524 and 36525. <br />E. Qualifying written protests constituting a majority of the owners of the <br />businesses paying the Annual Assessment were not received at or before the <br />conclusion of the public hearing. <br />Section 2. The 2018 Assessment Report is hereby confirmed, and the levy of <br />an assessment for the calendar year 2018 in accordance with Attachment B of the <br />Report, a copy of which is attached hereto and incorporated herein by reference, is <br />hereby approved. <br />Resolution No. 2017-089 <br />Page 1 of 3 <br />
