ABSTAIN: None (0) <br />ABSENT: None (0) <br />" Mayor Pulido and Councilmember Sarmiento, reported that out of an abundance of <br />caution and because an official advice letter from Fair Political Practices Commission <br />has not been receive, abstained on Agenda Item 85A and left the dais for the duration <br />of discussion. <br />COUNCIL AGENDA ITEMS <br />Pursuant to Santa Ana Charter Section 411, any member of the City Council may place items <br />on the City Council Agenda to be considered by the City Council. <br />85A REQUEST TO "CALL UP" PLANNING COMMISSION ITEMS <br />CONDITIONAL USE PERMIT (CUP) NOS. 2013 -2 -MOD AND 2013 -7 - <br />MODIFICATION TO DISCUSS THE ISSUE OF ALCOHOL CUPS IN THE <br />DOWNTOWN. UNDER THE REVISED ORDINANCE, THE CITY <br />COUNCIL, BY MAJORITY VOTE, MAY SET THIS MATTER FOR <br />REVIEW AT A PUBLIC HEARING (COUNCILMEMBER SOLORIO) <br />The following spoke on the matter: <br />• Jeffrey J. Jensen, owner of C4 Deli and Chapter 1, opined CUP <br />process was extremely difficult, and noted City of Santa Ana should be <br />more pro-business. <br />Councilmember Solorio, asked staff to present Planning Commissions <br />actions, current policy for alcohol sales, and any over concentration rules; <br />necessity to review of downtown city service needs, current revenue being <br />generated, and process of consideration 'by Planning Commission and <br />City Council. <br />Acting Executive Director of Planning and Building Neal, summarized <br />Planning Commission approval modification of existing CUP and after <br />hours permit. Presented City Council with current policy for alcohol sales <br />after hours, review process by Police Department, and City Councils <br />opportunity to appeal an action made by the Planning Commission. <br />Councilmember Tinajero, commented that Mr. Jensen was one of the first <br />to invest in Downtown Santa Ana when it wasn't profitable to do so, has a <br />successful business, and impeccable reputation. Noted calls for service <br />are paid by a special tax and asked to end this discussion and public <br />hearing to this matter. <br />Councilmember Benavides, reflected on investments in Downtown Santa <br />Ana, risk to business owners, and opined Downtown attracts residents <br />throughout Orange County.
