REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />FEBRUARY 6, 2018 <br />TITLE: <br />ADOPT RESOLUTION TERMINATING THE <br />JOINT POWERS AGREEMENT <br />ESTABLISHING THE COUNTYWIDE <br />PUBLIC FINANCING AUTHORITY AND <br />DISSOLVING THE AUTHORITY UPON <br />CONCURRENCE OF ALL MEMBERS <br />(STRATEGIC PLAN NO, 4, 1) <br />CITY MA AGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1st Reading <br />❑ Ordinance on 2nd Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Adopt a resolution terminating the Countywide Public Financing Authority (Authority) agreement and <br />dissolving the Authority upon concurrence of all its members. <br />DISCUSSION <br />In February 1996, the Orange County Board of Supervisors approved for the implementation and <br />operation of the Orange County 800 MHz Communication System. On June 19, 1996, a Joint <br />Powers Agreement was established among the cities of Brea, Buena Park, Fullerton, Garden <br />Grove, Orange, Seal Beach, Stanton, Tustin and Santa Ana in order to proportionately share the <br />financing of the Orange County wide 800 MHz Communications System. The 800 MHz <br />Communications system was to replace `the then UHF radio system which was obsolete. The <br />system was not encrypted, would not allow for multiple agency communication, and was limited <br />in frequencies. <br />In 1996 Revenue bonds in the approximate amount of $28 million were issued in order to finance <br />the various capital improvements within the boundaries of each of the participating cities. <br />Improvements and the bonds have been fully paid and the authority has no remaining assets, <br />liabilities or outstanding obligations. As such, the Countywide Public Financing is considered <br />inactive. The California State Controllers' Office is now requesting that any inactive Authority be <br />dissolved. <br />Bond Counsel, Quint & Thimmig, has indicated that if each city terminates the agreement and <br />authorizes dissolution of the Countywide Public Financing Authority, that this will suffice the <br />dissolution requirement required by the State Controllers' Office. <br />55A-1 <br />
