2017 LEGISLATIVE PLATFORM <br />(PD) SAPD continued to implement the City's <br />Measure BB initiative, which allowed for medical <br />marijuana dispensaries to lawfully operate in the <br />city. The Department aggressively reacted to <br />illegal dispensaries by partnering with code <br />enforcement to utilize traditional law <br />enforcement efforts, and the strategic use of <br />legal receiverships to close most illegal <br />dispensaries. <br />(PBA) Kept pace with a burgeoning industry and <br />new State regulations by adopting a commercial <br />cannabis ordinance that allows the safe <br />operation of cannabis retail businesses with the <br />goal of issuing permits for adult -use retail sales in <br />2018. <br />(PBA) Continued to allow the operation of <br />commercial cannabis retail businesses for <br />medicinal sales. <br />(PBA) Generated revenues to mitigate impacts <br />from new cannabis businesses to ensure safe <br />operation of commercial cannabis businesses <br />and to compensate for City services to regulate <br />and monitor the industry. <br />(PBA) Monitored developments at the State level <br />for implementation of Proposition 64, California <br />Marijuana Legalization Initiative. <br />(PD/PBA) In 2017, the City shut down 40 illegal <br />dispensaries and identified 14 illegal dispensaries <br />that continue to be the focus of the Task Force <br />enforcement efforts. <br />(PD/PBA) In collaboration with the Planning and <br />Building Agency, the Santa Ana Police <br />Department issued 18 Regulatory Safety Permits <br />related to Measure BB with an additional two in <br />process. <br />(CAO/PBA) In collaboration with the City <br />Attorney's Office, the Planning and Building <br />Agency continues to use a variety of enforcement <br />options to shut down illegal marijuana <br />dispensaries. This includes expanded the use of <br />the inspection/ abatement warrant process, <br />authorizing the installation of metal security <br />doors and window coverings to prevent anyone <br />from re-entering and re -occupying closed <br />dispensary sites. <br />(TPA) Worked closely with the Legislature, <br />Governor's Office, and various state agencies to <br />ensure that local control was protected as the <br />State considered various legislative and <br />regulatory proposals. TPA provided regular <br />updates to the City regarding various aspects of <br />regulations that were being considered by the <br />State, as well as providing State regulators with <br />feedback on potential impacts to the City. <br />(HK) In light of the Department of Justice's <br />memorandum on marijuana enforcement and <br />rescission of the Cole memo, it is important that <br />we continue to monitor federal developments <br />that may impact City and state regulation. It <br />should also be noted that a bipartisan bill, known <br />as the Compassionate Access Act, was re- <br />introduced that would remove cannabidiol (CDB) <br />from the Controlled Substances Act so that <br />physicians — with state approval of its use — could <br />prescribe such treatment, as in the case of <br />epilepsy, cancer or glaucoma. <br />(HK) The Fiscal Year 2017 Commercial, Justice, <br />and Sciences Appropriations bill includes the <br />Rohrabacher-Blumenauer Amendment, which <br />prohibits the Justice Department from spending <br />funds to interfere with the implementation of <br />state medical cannabis laws.
