NWRANCE Oil WORK MAY PNC UNI IL UvsU�Ar "";E �B ER, ION OF AGREEMENT FOR COLLECTION AND HANDLING OF to` �4✓��i CONSTRUCTION AND DEMOLITION DEBRIS GENERATED, PRODUCED, C.Inr�3ti AND/OR ACCUMULATED AT TEMPORARY CONSTRUCTION SITES IN THE CITY OF SANTA ANA A-2017-366 This EXTENSION OF AGREEMENT FOR COLLECTION AND HANDLING OF CONSTRUCTION AND DEMOLITION DEBRIS GENERATED, PRODUCED, AND/OR ACCUMULATED AT TEMPORARY CONSTRUCTION SITES IN THE CITY OF SANTA ANA (`Extension") is made and entered into this 19th day of December, 2017 by and between the City of Santa Ana, a charter city and municipal corporation duly organized and existing under the Constitution and laws of the State of California ("City") and Waste Management Collection and Recycling, Inc., a California corporation dba Waste Management of Orange County ("Contractor"). RECITALS A. City and Contractor, under the legal name "USA Waste of California, Inc.", entered into Agreement No. A-2005-259, dated October 3, 2005, by which City granted to Contractor a non-exclusive right to collect, recycle, divert, and transport to appropriate facilities any construction and demolition debris generated, produced, and/or accumulated at temporary construction sites in the City ("Agreement"). B. The original teen of the Agreement continued through June 30, 2008, subject to extension. C. On April 3, 2006, the Agreement was amended to extend the term through June 30, 2018 by the document entitled "First Amended and Restated Agreement for Collection and Handling of Construction and Demolition Debris Generated, Produced, and/or Accumulated at Temporary Construction Sites in the City of Santa Ana", Agreement No, A-2006-076. The rate structure was amended as well. D. The parties now wish to further extend the Agreement: through June 30, 2020, subject to a one-year extension, and clarify Contractor's legal name, which has changed since the time of the original Agreement. The Parties therefore agree: I . The tear of the Agreement shall be extended through June 30, 2020. The term may be further extended for one year upon mutual agreement by the parties. 2. All references to "Contractor" in the Agreement shall mean "Waste Management Collection and Recycling, Inc., a California corporation dba Waste Management of Orange County: 3. This Extension shall take effect only upon fill execution, by the parties thereto, of the "Extension of Fourth Amended and Restated Agreement for Collection and Handling of Solid Waste Generated and/or Accumulated in the City of Santa Ana", by and between City and Contractor and dated December 5, 2017.
