REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />MARCH 6, 2018 <br />TITLE: <br />EXTENSION OF CONDITIONAL USE <br />PERMIT NO. 2015-01 AND VARIANCE NOS. <br />2015-01 AND 2015-02 FOR THE SOUTH <br />COAST SPEEDWASH TO BE LOCATED AT <br />2402 SOUTH BRISTOL STREET <br />(STRATEGIC PLAN NO. 3,2) <br />TY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1 s' Reading <br />❑ Ordinance on 2n1 Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Adopt a resolution approving the extension of Conditional Use Permit No. 2015-01 and Variance <br />Nos. 2015-01 and 2015-02. <br />DISCUSSION <br />In April 2015, the City Council approved Conditional Use Permit (CUP) No. 2015-01 and Variance <br />Nos. 2015-01 and 2015-02 for the South Coast Speedwash development at 2402 South Bristol <br />Street. The conditional use permit allowed the use of the property for a car wash facility, and the <br />variances were to allow a reduction in required setbacks and parking. Due to the complexities of <br />the project and the challenges of securing services required to engineer the mixed-use project site, <br />which includes a car wash, administration building, and a multi -tenant commercial building, the <br />applicant was unable to move forward with construction before the entitlements expired. <br />Pursuant to Section 41-647 of the Santa Ana Municipal Code (SAMC), CUPS, variances, and other <br />entitlements automatically become void should the property owner fail to institute an action to <br />comply with the provisions of the entitlements within two years of its approval. This section of the <br />code also allows the property owner to request an extension of the entitlement up to a period of <br />three years from the date of expiration. Although above -ground construction has yet to begin, the <br />applicant would like to maintain the entitlements for the CUP and variances and is requesting a <br />second one-year extension of the approvals. In December 2017, the City issued construction <br />permits for the project; however, due to continued complexities of the project, the applicant has <br />been unable to begin above -ground construction and a second extension of the original <br />entitlements is required. The first one-year extension was approved by City Council on March 7, <br />2017. Since the applicant is planning to move forward with the project, the Planning Division <br />recommends that the entitlements for the mixed-use car wash development be extended by a <br />period of one year from the date of City Council approval. <br />5513-1 <br />
