CNA CNA PARAMOUNT <br />Cancellation / Non -Renewal — Ohio <br />Wherever used in this endorsement: 1) Insurer means "we", "us", "our" or the "Company" as those terms may be defined <br />in the policy; and 2) Named Insured means the first person or entity named on the declarations page; and 3) "Insureds" <br />means all persons or entities afforded coverage under the policy. <br />Any cancellation, non -renewal or termination provisions in the policy are deleted in their entirety and replaced with the <br />following: <br />CANCELLATION AND NON -RENEWAL <br />A. CANCELLATION <br />1. The Named Insured may cancel the policy at any time. To do so, the Named Insured must return the <br />policy to the Insurer or any of its authorized representatives, indicating the effective date of cancellation; <br />or provide a written notice to the Insurer, stating when the cancellation is to be effective. <br />2. The Insurer has the right to cancel this policy at any time and for any reason within the first ninety (90) <br />days. Notice of cancellation must be mailed at least sixty (60) days prior to the effective date of such <br />cancellation, except that if the cancellation is for non-payment of premium, the Insurer must mail notice of <br />cancellation no later than ten (10) days prior to the effective date of such cancellation. <br />3. After this policy has been in effect for ninety (90) days or more, it may be canceled for one of the <br />following reasons: <br />a. Non-payment of premium. <br />b. Discovery of fraud or material misrepresentation in the procurement of the insurance or with <br />respect to any claims submitted thereunder; <br />C. Discovery of a moral hazard or willful or reckless acts or omissions on the part of the named <br />insured that increase any hazard insured against; <br />J. Occurrence of a change in the individual risk which substantially increases any hazard insured <br />against after insurance coverage has been issued or renewed, except to the extent the insurer <br />reasonably should have foreseen the change or contemplated the risk in writing the contract; <br />e. Loss of applicable reinsurance or a substantial decrease in applicable reinsurance, if the <br />superintendent has determined that reasonable efforts have been made to prevent the loss of, or <br />substantial decrease in, the applicable reinsurance, or to obtain replacement coverage;. <br />f. A determination by the superintendent of insurance that the continuation of the policy would <br />create a condition that would be hazardous to the policyholders or the public. <br />g. Failure of the insured to correct material violations of safety codes or to comply with reasonable <br />written loss control recommendations. <br />4. The notice of cancellation required by this must be in writing, be mailed to the insured at the insured's <br />last know address, and contain all of the following: <br />1. The policy number; <br />2. The date of the notice; <br />3. The effective date of the cancellation; <br />4. An explanation of the reason for cancellation. <br />5.
