(REVISED) ADOPT THE DRAFT AGGRESSIVE AND SAFE PANHANDLING ORDINANCE AS <br />DISCUSSED AT PUBLIC SAFETY COUNCIL COMMITTEE MEETING - COUNCILMEMBER SOLORIO <br />(SOLORIO, MARTINEZ, AND VILLEGAS) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA ADOPTING ARTICLE XII REGULATING AGGRESSIVE AND INTRUSIVE <br />SOLICITATION ORDINANCE IN CHAPTER 10 THE SANTA ANA MUNICIPAL CODE <br />But THTC a jC have real reservations <br />85B. (REVISED) IN AN EFFORT TO COUNTERACT A DIVISIVE AND DESTRUCTIVE ANTI- <br />IMMiGRANT SENTIMENT BROUGHT FORTH BY RECENT ACTIONS TAKEN BY CERTAIN <br />ORANGE COUNTY ELECTED BODIES WHICH CAN POTENTIALLY BE HARMFUL TO THE <br />RESIDENTS AND COMMUNITY OF SANTA ANA, DIRECT CITY ATTORNEY AND STAFF TO TAKE <br />CERTAIN ACTIONS, INCLUDING BUT NOT LIMITED TO PREPARING AND FILING AN AMICUS <br />BRIEF IN THE MATTER OF THE UNITED STATES V. THE STATE OF CALIFORNIA, ET. AL., CASE <br />NO. 18-264, TO SUPPORT THE PREMISE THAT THE TENTH AMENDMENT PROTECTS STATES AND <br />LOCAL GOVERNMENTS FROM BEING COMPELLED OR COERCED TO ENFORCE EXCLUSIVELY <br />RESERVED FEDERAL FUNCTIONS. IN ADDITION, CLARIFY AND MORE ACCURATELY REFLECT <br />THE FOLLOWING TO THE PUBLIC: <br />RECOMMENDED ACTION. 1. SANTA ANA'S SANCTUARY CITY ORDNANCE NO. NS -2908, <br />SIMPLY CODIFIES PUBLIC SAFETY PRACTICES THAT HAVE BEEN N EFFECT FOR OVER 40 <br />YEARS. THESE PRACTICES COMPLY WITH ALL FEDERAL LAWS, INCLUDING 8 U.S.C. SECTION <br />1373, AND RESULT N EFFECTIVE PUBLIC SAFETY STRATEGIES. IN ESSENCE, SANTA ANA <br />PRIORITIZES LOCAL LAW ENFORCEMENT, INSTILLS TRUST N OUR RESIDENTS, AND <br />PROTECTS AND SERVES ALL MEMBERS OF OUR COMMUNITY, AND 2. SANTA ANA VALUES <br />THE CONTRIBUTIONS MADE BY ALL MEMBERS OF OUR COMMUNITY.
