Plumlee, City Manager <br />From: Warren Kusumoto, Mayor Pro Tem <br />Subject: Introduce Ordinance No. 2018-03 — Adding Chapter 9.30 Constitution <br />of the United States Compliance <br />Summary: This is an opportunity to discuss the Council's desire to show its resolve <br />and support for the Constitution of the United States by adopting a Resolution or <br />Ordinance. <br />Recommendations: <br />1. Introduce for first reading, read by title only, and waive further reading of <br />Ordinance No. 2018-03; and, <br />2. City Attorney Daudt read the title of Ordinance No. 2018-03 entitled "AN <br />ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LOS ALAMITOS, <br />CALIFORNIA, ADDING CHAPTER 9.30 CONSTITUTION OF THE UNITED <br />STATES COMPLIANCE." <br />Background and Discussion <br />The California Values Act (S1354) is contrary to the United States Constitution and <br />infringes on the rights of the citizens of the City of Los Alamitos. Furthermore, it affects <br />the City Council's oath to support and defend the Constitution of the United States. <br />In view of this contradiction, it is impossible to comply with both the Constitution of the <br />United States and the Constitution of the State of California. When two governing <br />documents contradict each other, the order of precedence needs to be invoked and <br />followed. <br />In this situation, my belief is that the Constitution of the United States has precedence <br />over the Constitution of the State of California, so therefore I am proposing that the City <br />Council discuss and adopt Ordinance No. 2018-03 to exempt the City of Los Alamitos <br />from the California Values Act. <br />
