Mayor Pulido and Members of the City Council <br />April 2, 2018 <br />Page 5 <br />Madison parking structure and the inevitability of overflow parking migrating to the Xerox <br />Building parking structure, the effects of a parking variance on the users of the Xerox <br />Building parking structure have not been evaluated or taken into consideration. We urge <br />the Council to follow the recommendations of both Staff and the Planning Commission and <br />not grant the variance. <br />• Number of Units. As a point of information for the City, the project site is subject to CC&Rs <br />which presently limit the number of residential units to 250. While this may be considered <br />by the City to be a private matter, we simply want to make the City aware of this limitation <br />and that, absent a resolution of issues which impact the Xerox Building and its tenants and <br />visitors, the owner of the Xerox Building is not likely to consider agreeing to increasing the <br />allowable number of units to the 260 units requested by the project applicant. <br />Except as noted above, the owner of the Xerox Building supports the proposed project. These <br />issues which impact the Xerox Building, however, need to be addressed before the project is <br />approved• We ask the Council to continue the hearing for 30 days to allow Mr• Bisno to resolve <br />these issues. <br />Sincerely, <br />Tim Paone <br />
