Residential Units <br />Assumed No. of Persons in <br />Household for Affordable Rent <br />Calculation <br />Studio <br />1 <br />One Bedroom <br />2 <br />Two Bedroom <br />3 <br />C. "Affordable Tenant Rental Period" means with respect to the Project, the period <br />commencing on the date of issuance of the occupancy permit and ending at the expiration of <br />thirty (30) years. <br />D. "Completion of the Project" shall mean the date on which the certificate of <br />occupancy is issued by City for occupancy in the Project. <br />E. "Density bonus" means the number of dwelling units approved by City for <br />development on the Property which exceeds the number specified in Recital D of this <br />Agreement. <br />F. "Development" means construction or rehabilitation or a combination thereof. <br />G. "Income Certification" means an income certification for very low or lower <br />income tenants in a form set forth in `Exhibit B," attached hereto and incorporated herein by this <br />reference as if set forth in full. <br />H. "Lower -Income Tenant" means persons and families whose income does not <br />exceed eighty percent (80%) of the median income for the area, as computed by the method <br />described in the income certificate and for whom an income certification has been obtained or <br />prepared in accordance with the provisions of this Agreement. <br />For purposes of satisfying the lower-income tenant occupancy requirement set forth <br />above, a unit occupied by a person or family who at the commencement of occupancy qualified <br />as a lower-income tenant shall be treated as occupied by a lower-income tenant throughout their <br />tenancy of such unit. Moreover, a unit occupied by a lower-income tenant shall be deemed, <br />upon the termination of such lower-income tenant's occupancy, to be continuously occupied by a <br />lower-income tenant until reoccupied, other than for a temporary period, at which time the <br />character of the unit shall be redetermined. In no event shall such temporary period exceed <br />thirty-one (3 1) days. The very low and lower income units will be intermingled with all other <br />dwelling units in the Project and shall be of a quality and offer a range of sizes and number of <br />bedrooms comparable to those units which are available to other tenants. Tenants in the very <br />low and lower income units shall have equal access and enjoyment to all common facilities of <br />the Project. <br />I. "Very Low Income Tenant" means persons and families whose income does not <br />exceed fifty (50%) of the median income for the area, as computed by the method described in <br />-3- <br />60E-7 <br />
