The City should not transfer or "sell" this land to the people that encroached upon the city's open space. Santa
Ana should not be "virtually giving away" the very limited open space/parkland it has to any residential users
that have encroached upon the city's land.
The portion of the "improvements" encroaching upon city property should be removed and the land restored to
its natural condition, all at the expense of the residents. Or, perhaps as a unique option,the encroaching tennis
court should be made accessible to Santa Ana residents.
At an absolute minimum, the land should be sold for fair market value, plus an additional sum to represent the
opportunity cost for loss of use as open space for as long as the encroachment has existed, along with a separate
penalty for encroaching upon city property. This latter option, however, would set a precedent that may
encourage others to similarly encroach upon city land in the future. The cost to them has to be inordinately high,
as these people literally stole city land and should not benefit from doing so!
