The 5-Year and Annual PHA Plans provide a ready source for interested parties to locate basic PHA policies, rules, and requirements concerning the PHA’s operations, programs, and services, and informs HUD, families served by the PHA, and members of the public of the P HA’s mission, goals and objectives for serving the needs of low- income, very low- income, and extremely low- income families Applicability. Form HUD-50075-HCV is to be completed annually by HCV-Only PHAs. PHAs that meet the definition of a Standard PHA, Troubled PHA, High Performer PHA, Small PHA, or Qualified PHA do not need to submit this form. Where applicable, separate Annual PHA Plan forms are available for each of these types of PHAs. Definitions. (1) High-Performer PHA – A PHA that owns or manages more than 550 combined public housing units and housing choice vouchers, and was designated as a high performer on both of the most recent Public Housing Assessment System (PHAS) and Section Eight Management Assessment Program (SEMAP) assessments if administering both programs, or PHAS if only administering public housing. (2) Small PHA - A PHA that is not designated as PHAS or SEMAP troubled, or at risk of being designated as troubled, that owns or manages less than 250 public housing units and any number of vouchers where the total combined units exceeds 550. (3) Housing Choice Voucher (HCV) Only PHA - A PHA that administers more than 550 HCVs, was not designated as troubled in its most recent SEMAP assessment, and does not own or manage public housing. (4) Standard PHA - A PHA that owns or manages 250 or more public housing units and any number of vouchers where the total combined units exceeds 550, and that was designated as a standard performer in the most recent PHAS and SEMAP assessments. (5) Troubled PHA - A PHA that achieves an overall PHAS or SEMAP score of less than 60 percent. (6) Qualified PHA - A PHA with 550 or fewer public housing dwelling units and/or housing choice vouchers combined, and is not PHAS or SEMAP troub led. A. PHA Information. Depending on funding availability, SAHA plans to issue a Request for Proposals (RFP) for project-based vouchers. SAHA prefers to maximize the impact of project-based vouchers to reduce chronic homelessness and veteran homelessness to functional zero requiring the project-based vouchers to be restricted to permanent supportive housing units using the Housing First model with the Continuum of Care Coordinated Entry System. The projected number of project-based units depends on funding availability. The general locations for the project-based vouchers will be in areas of high opportunity with low concentrations of poverty, access to amenities and services, walkability to transit, and financial feasibility of the proposed project, among other selection criteria defined in the RFP. Project-basing vouchers will be consistent with the PHA Plan because it will more effectively meet our strategy for addressing the most pressing housing needs of our community than regular tenant-based vouchers. EXHIBIT 1 4-4 Page 3 of 5 form HUD-50075-HCV (12/2014) B.6 Progress Report. Provide a description of the PHA’s progress in meeting its Mission and Goals described in its 5-Year PHA Plan. Goal # 1: Expand the supply of affordable housing by applying for additional Housing Choice Vouchers when available. Apply for any new funding opportunities.  The Housing Authority of the City of Santa Ana (SAHA) received an award of 100 HUD-Veterans Affairs Supportive Housing Project- Based Vouchers (HUD-VASH PBVs) under PIH Notice 2017-17 and an additional award of 105 HUD-VASH tenant-based vouchers under PIH Notice2018-07.  Following the award of HUD-VASH PBVs under PIH Notice 2017-17, SAHA issued an RFP and committed the 100 HUD-VASH PBVs to three affordable housing projects including: 8 HUD-VASH PBVs committed to National CORE for the development of the Santa Ana United Methodist Church project which will include 93 total units of which 33 will be permanent supportive housing; 3 HUD-VASH PBVs committed to HomeAid Orange County for the development of the Frances Xavier project which will include 11 units of permanent supportive housing; and 89 HUD-VASH PBVs committed to Jamboree Housing for the rehabilitation of the Budget Inn motel to create 89 permanent supportive housing units for qualified and eligible homeless veterans.  In September 2018, SAHA also received an award of 50 Mainstream Vouchers following a competitive application process under 2017 Mainstream Voucher Program NOFA FR-6100-N-43. Goal # 2: Improve the quality of assisted housing by improving voucher management, increasing customer satisfaction, and improving specific management functions.  Retain high performer SEMAP status: SAHA was certified as a High Performer for FFY 2018.  Under SAHA’s Quality Control Program, SAHA seeks to continually improve the quality of assisted housing by improving voucher management, increasing customer satisfaction, and improving specific management functions. Specifically, for FFY 2018 SAHA audited a total of 420 files under SEMAP Indicator # 3, even though the minimum sample size required by HUD was only 34 files. For SEMAP Indicator # 5, SAHA audited a total of 84 inspections even though the minimum sample size required b y HUD was only 32 quality control inspections.  Maintain leasing to 100% of HAP funding: SAHA utilized 102.0% of our Annual Budget Authority from HUD for CY 2018. Goal # 3: Increase assisted housing choices, portability counseling to 100% of participants, conducting outreach to potential property owner.  Continue to mail owner/participant newsletters: Since December 2015, SAHA has been e-mailing a monthly electronic Landlord Newsletter to all owners. In October 2016, SAHA began sending a monthly electronic Housing Plus Program Newsletter (aka Family Self-Sufficiency Program) to our participants who have provided us with their e-mail addresses.  Implement annual customer satisfaction survey: No update Goal # 4: Promote self-sufficiency by increasing employment among participants, linking to supportive services to increase independence for the elderly and/or disabled, and increase participation in the Family Self Sufficiency (FSS) program.  Continue to provide referrals to the Santa Ana W/O/R/K Center for job training and placement services, providing information and linkages to the County’s Council on Aging (elderly services) and the Dayle McIntosh Center (disabled services), and conducted recruitment for the FSS program at initial voucher issuance, at annual re-examinations, and through tenant newsletters: SAHA hired a full-time Workforce Specialist I / FSS Coordinator effective February 2, 2018. The Workforce Specialist I has been working to increase participation in the program through outreach and engagement while also providing monthly case management to participants in the program. The Workforce Specialist I is co-located in the Santa Ana W/O/R/K Center through a Memorandum of Understanding. SAHA also requires in any RFPs for project-based vouchers that a developer into an agreement with the Santa Ana Work Center. Goal # 5: Ensure equal opportunity and affirmatively further fair housing through coordination with the Orange County Fair Housing Council, the preparation of the Analysis of impediments to fair housing choice, and continued training on fair housing practi ces for staff owner’s and participants.  Fair Housing programs and resources are included in all issuance briefings, reason able accommodation tracking logs updated. Communication was maintained with the County’s Fair Housing Council, Public Law Center, and Legal Aid, ensuring proper referr als for anyone alleging discrimination, whether an HCV participant or member of the publi c: In August 2018, SAHA held an annual Fair Housing Training for all Housing Division employees. This annual training is required for all employees.  Assist the City of Santa Ana in maintaining of the housing Stock: No update Goal # 6: Ensure assisted families obtain information, maintain housing and prevent domestic violence in accordance with Vio lence Against Women Act (VAWA) of 2005.  In accordance with the Violence against Women Reauthorization Act of 2013 (VAWA 2013), SAHA implemented an Emergency Transfer Plan for Victims of Domestic Violence, Dating Violence, Sexual Assault, or Stalking.  SAHA also implemented HUD-5380, Notice of Occupancy Rights under the Violence Against Women Act, HUD-5382, Certification of Domestic Violence, Dating Violence, Sexual Assault, or Stalking, and Alternate Documentation, and HUD-5383, Emergency Transfer Request for Certain Victims of Domestic Violence, Dating Violence, Sexual Assault, or Stalking.  SAHA coordinates with the County of Orange Domestic Violence office for referrals and to ensure applicants and participants are informed on all available services.  Information on VAWA in regards to owner/tenant responsibilities and evictions is provided to all program applicants and parti cipants and also mailed to all owners.  SAHA’s HCV Administrative Plan details restrictions on terminating assistance for victims of domestic violence, as well as guidelines on terminating assistance for perpetrators of domestic violence.  At a minimum, SAHA trains staff on VAWA at least once annually. Staff also proactively provides information on VAWA to any program participant or applicant who may show any evidence that information on VAWA is needed. EXHIBIT 1 4-5 Page 4 of 5 form HUD-50075-HCV (12/2014) B.7 Resident Advisory Board (RAB) Comments. (a) Did the RAB(s) provide comments to the PHA Plan? Y N (a) If yes, comments must be submitted by the PHA as an attachment to the PHA Plan. PHAs must also include a narrative describing their analysis of the RAB recommendations and the decisions made on these recommendations. Three Resident Advisory Board meetings were held on January 22, 2019. The meetings were conducted in three languages: English, Spanish, and Vietnamese. All active participants were mailed an invitation to participate on the Resident Advisory Board. Please see attachment for RAB Comments. Staff analyzed all of the recommendations from the Resident Advisory Board by: 1) considering the feasibility of each recommendation; 2) discussing as a team the opportunity for SAHA to implement each recommendation; and 3) making a determination on which recomm endation(s) could be implemented or considered for future implementation. All of the recommendations have been taken into consideration by the housing authority staff and management. Instructions for Preparation of Form HUD-50075-HCV Annual PHA Plan for HCV Only PHAs ___________________________________________________________________________ A. PHA Information. All PHAs must complete this section. (24 CFR §903.23(4)(e)) A.1 Include the full PHA Name, PHA Code, PHA Type, PHA Fiscal Year Beginning (MM/YYYY), Number of Housing Choice Vouchers (HCVs), PHA Plan Submission Type, and the Availability of Information, specific location(s) of all information relevant to the public hearing and proposed PHA Plan. PHA Consortia: Check box if submitting a Joint PHA Plan and complete the table. (24 CFR §943.128(a)) B. Annual Plan. All PHAs must complete this section. (24 CFR §903.11(c)(3)) B.1 Revision of PHA Plan Elements. PHAs must: Identify specifically which plan elements listed below that have been revised by the PHA. To specify which elements have been revised, mark the “yes” box. If an element has not been revised, mark “no." Housing Needs and Strategy for Addressing Housing Needs. Provide a statement addressing the housing needs of low-income, very low-income families who reside in the PHA’s jurisdiction and other families who are on the Section 8 tenant -based waiting list. The statement must identify the housing needs of (i) families with incomes below 30 percent of area median income (extremely low-income), (ii) elderly families and families with disabilities, and (iii) households of various races and ethnic groups residing in the jurisdiction or on the waiting list based on information provided by the applicable Consolidated Plan, information provided by HUD, and other generally available data. The identification of housing needs must address issues of affordability, supply, quality, accessibility, size of units, and location. (24 CFR §903.7(a)(1) and 24 CFR §903.7(a)(2)(i)). Provide a description of the PHA’s strategy for addressing the housing needs of families in the jurisdiction and on the waiting list in the upcoming year. 24 CFR §903.7(a)(2)(ii) Deconcentration and Other Policies that Govern Eligibility, Selection, and Admissions. A statement of the PHA’s policies that govern resident or tenant eligibility, selection and admission including admission preferences for HCV. (24 CFR §903.7(b)) Financial Resources. A statement of financial resources, including a listing by general categories, of the PHA’s anticipated resources, such as PHA HCV funding and other anticipated Federal resources available to the PHA, as well as tenant rents and other income available to support t enant-based assistance. The statement also should include the non-Federal sources of funds supporting each Federal program, and state the planned use for the resources. (24 CFR §903.7(c)) Rent Determination. A statement of the policies of the PHA governing rental contributions of families receiving tenant-based assistance, discretionary minimum tenant rents , and payment standard policies. (24 CFR §903.7(d)) Operation and Management. A statement that includes a description of PHA management organization, and a listing of the programs administered by the PHA. (24 CFR §903.7(e)(3)(4)). Informal Review and Hearing Procedures. A description of the informal hearing and review procedures that the PHA makes available to its applicants. (24 CFR §903.7(f)) Homeownership Programs. A statement describing any homeownership programs (including project number and unit count) administered by the agency under section 8y of the 1937 Act, or for which the PHA has applied or will apply for approval. (24 CFR §903.7(k)) EXHIBIT 1 4-6 Page 5 of 5 form HUD-50075-HCV (12/2014) Self Sufficiency Programs and Treatment of Income Changes Resulting from Welfare Program Requirements. A description of any PHA programs relating to services and amenities coordinated, promoted, or provided by the PHA for assisted families, including those resulting from the PHA’s partnership with other entities, for the enhancement of the economic and social self-sufficiency of assisted families, including programs provided or offered as a result of the PHA’s partnerships with other entities, and activities under section 3 of the Housing and Community Development Act of 1968 and under requirements for the Family Self-Sufficiency Program and others. Include the program’s size (including required and actual size of the FSS program) and means of allocating assistance to households. (24 CFR §903.7(l)(i)) Describe how the PHA will comply with the requirements of section 12(c) and (d) of the 1937 Act that relate to treatment of income changes resulting from welfare program requirements. (24 CFR §903.7(l)(iii)). Substantial Deviation. PHA must provide its criteria for determining a “substantial deviation” to its 5-Year Plan. (24 CFR §903.7(r)(2)(i)) Significant Amendment/Modification. PHA must provide its criteria for determining a “Significant Amendment or Modification” to its 5-Year and Annual Plan. Should the PHA fail to define ‘significant amendment/modification’, HUD will consider the following to be ‘significant amendments or modifications’: a) changes to rent or admissions policies or organization of the waiting list; or b) any change with regard to homeownership programs. See guidance on HUD’s website at: Notice PIH 1999-51. (24 CFR §903.7(r)(2)(ii)) If any boxes are marked “yes”, describe the revision(s) to those element(s) in the space provided. B.2 New Activity. If the PHA intends to undertake new activity using Housing Choice Vouchers (HCVs) for new Project-Based Vouchers (PBVs) in the current Fiscal Year, mark “yes” for this element, and describe the activities to be undertaken in the space provided. If the PHA does not plan to undertake this activity, mark “no.” (24 CFR §983.57(b)(1) and Section 8(13)(C) of the United States Housing Act of 1937. Project-Based Vouchers (PBV). Describe any plans to use HCVs for new project-based vouchers. If using PBVs, provide the projected number of project-based units and general locations, and describe how project-basing would be consistent with the PHA Plan. B.3 Most Recent Fiscal Year Audit. If the results of the most recent fiscal year audit for the PHA included any findings, mark “yes” and describe those findings in the space provided. (24 CFR §903.11(c)(3), 24 CFR §903.7(p)) B.4 Civil Rights Certification. Form HUD-50077, PHA Certifications of Compliance with the PHA Plans and Related Regulation, must be submitted by the PHA as an electronic attachment to the PHA Plan. This includes all certifications relating to Civil Rights and related regulations. A PHA will be considered in compliance with the AFFH Certification if: it can document that it examines its programs and proposed programs to identify any impediments to fair housing choice within those programs; addresses those impediments in a reasonable fashion in view of the resources available; works with the local jurisdiction to implement any of the jurisdiction’s initiatives to affirmatively further fair housing; and assures that the annual plan is consistent with any applicable Consolidated Plan for its jurisdiction. (24 CFR §903.7(o)) B.5 Certification by State or Local Officials. Form HUD-50077-SL, Certification by State or Local Officials of PHA Plans Consistency with the Consolidated Plan, including the manner in which the applicable plan contents are consistent with the Consolidated Plans , must be submitted by the PHA as an electronic attachment to the PHA Plan. (24 CFR §903.15) B.6 Progress Report. For all Annual Plans following submission of the first Annual Plan, a PHA must include a brief statement of the PHA’s progress in meeting the mission and goals described in the 5-Year PHA Plan. (24 CFR §903.11(c)(3), 24 CFR §903.7(r)(1)) B.7 Resident Advisory Board (RAB) comments. If the RAB provided comments to the annual plan, mark “yes,” submit the comments as an attachment to the Plan and describe the analysis of the comments and the PHA’s decision made on these recommendations. (24 CFR §903.13(c), 24 CFR §903.19) This information collection is authorized by Section 511 of the Quality Housing and Work Responsibility Act, which added a ne w section 5A to the U.S. Housing Act of 1937, as amended, which introduced the Annual PHA Plan. The Annual PHA Plan provides a ready source for interested parties to locate basic PHA policies, rules, and requirements concerning the PHA’s operations, programs, and services, and informs HUD, families served by the PHA, and members of the public for serving the needs of low- income, very low- income, and extremely low- income families. Public reporting burden for this information collection is estimated to average 4.5 hour per response, including the time for reviewing instructions, searching existing data sources, gathering and maintaining the data needed, and completing and reviewing the collection of information. HUD may not collect this information, and respondents are not required to complete this form, unless it displays a currently valid OMB Control Number. Privacy Act Notice. The United States Department of Housing and Urban Development is authorized to solicit the information requested in this form by virtue of Title 12, U.S. Code, Section 1701 et seq., and regulations promulgated thereunder at Title 12, Code of Federal Regulations. Housing Needs and Strategy for Addressing Housing Needs _Top 3 housing needs are: 1. Not having enough vacant units and not enough landlords take housing tenants; 2. Utilities costs billed by landlords are too high and are unevenly distributed (per unit instead of people in household; 3) Lack of affordable housing units for low income families.. Lack of space in housing unit – maybe general storage might be considered. Lack of communication between the Housing Authority/Landlord and Tenant. Lack of information regarding portability. Lack of vacancy listings in different locations to provide better housing choices. Develop means to better communicate about program requirements and be more informative of different process: reporting change, portability program, HCV program. Solutions: Build more affordable housing units for Senior citizens, disabled families. Provide a better list of vacant units. EXHIBIT 1 4-17 c. Eligibility, Selection and Admissions Policies, including Deconcentration and Waiting List Procedures Recommendations: 1) Speed up the filtering process/review/approving process of housing applications. 2) People that are already on housing should not be able to apply for housing since they’ve already received housing assistance- should be filtered out at the onset. 3) Change the waiting list priorities. Priority should be given to senior citizens, disabled persons. 4) The waiting list should be open more often. d. Rent Determination Policies Give priority to single bedroom and two bedrooms in rent determination since those mainly serve senior citizens and disabled families. Approve rent at market value or at 98% of the fair market rent to combat the increased rent. Owner should accept housing because owners are still getting paid the same amount of rent regardless of where the money is coming from. e. Operation and Management Recommends: Annual meetings should be done quarterly. Monthly electronic Tenant Newsletter has potential to keep a tenant well informed & current. Can also provide information regarding Gosection8, Housing Choice Voucher program, portability program, listing of new units, new landlords, reminder regarding reporting changes. Inspections help because any maintenance issues can be addressed to the landlords f. Grievance Procedures Possibly giving more than 10 days if tenant needs to submit a grievance/request a review. Provide more information, more frequently, in more languages. Extend the 10 day to 30 days to file a grievance because the participant may be in the hospital or is mentally unstable. State the obligations and procedures in block letters and state the consequences if the participant fails. Provide counsel, suggestions, recommendations and list options available, consequences. Notification of consequences. EXHIBIT 1 4-18 Housing Plus Program Notify the housing tenants who have employments of the escrow account immediately. Notify housing tenants of regulations and policies governing withdrawals. SAHA to offer classes to educate tenants. This program is well designed to help the participant become independent. See this program as a stepping stone for those who qualify. To encourage others who would be interested in the HOME housing program, offer: Education conventions, expose to different careerpaths, different trade schools, provide information about short- term certificate programs at the Santa Ana Community College. What help can be given to a live-in-aide who is unemployed? Provide information to family members to participate in the Housing Plus program because family members may not know about the program. g. Progress in Meeting Mission and Goals Goal should be to provide affordable housing for working people and their families. The housing program mission can improve by extending the application from one month to three months. This area is in needs to assist the low-income population. Funds from the Federal Program should be extended to serve not only a certain number, but expand to those that qualify. SAHA move for improvement: to see clients one on one, on a case by case basis. h. Other Recommendations Not Listed Above Government shut down effects voucher for senior citizens and disabled families. Very important for the City Mayor and Council Members to take action for clients on Section 8. The program is working to assist people to become self-sufficient and securing a home which then would allow the participant to seek furthering their education. Provide legal advice. SAHA should provide tenants with consequences of the actions that they can take (for example notify by phone that not reporting changes on time will result in termination weekly or monthly). Housing Authority is also the last line of defense for owner rent increases. Give more time on the voucher to be able to find a unit when moving. The Housing Authority of the City of Santa Ana conclusively finds, determines and declares as follows: A. The Housing Authority of the City of Santa Ana (the “Authority”) is required by the U.S. Department of Housing and Urban Development (“HUD”) to have an Annual Plan due to the fact that the Authority administers a Housing Choice Voucher (“HCV”) Rental Assistance Program. B. The purpose of the Authority’s Annual Plan is to advise HUD, program participants and members of the public of its mission and strategy to serve the needs of very low-income families. It provides information about the current operations of the Authority, including programs, participants, services for the upcoming year, and any operational or tenant concerns. C. The Authority is required to review its operations and needs for the Annual Plan with input from HCV participants. Three (3) Resident Advisory Board Meetings were held on January 22, 2019, with responses incorporated into the Annual Plan, as required by HUD regulations. D. HUD regulations require a forty-five (45) day comment period. On February 2, 2019, notification was published in the Orange County Register newspaper that the draft plan was available for public review. Additional notice of the public review period was also provided in the Nguoi Viet and La Opinion newspapers on February 5, 2019. The public comment period ended on March 19, 2019. Further, a public hearing was held by the Housing Authority on March 19, 2019, and all comments received at the hearing are included in the final documents to be submitted to HUD. Section 2. The Annual Plan for Fiscal Years 2019-2020 of the Housing Authority of the City of Santa Ana is hereby approved and adopted. Said Annual Plan shall be submitted by the Authority to HUD. Section 3. This Resolution shall take effect immediately upon its adoption by the Authority Board, and the Recording Secretary for the Authority shall attest to and certify the vote adopting this Resolution.
