HomeMy WebLinkAboutHCI ENVIRONMENTAL & ENGINEERING SERVICEINSURANCE NOT ON FILE WORK MAY V PROCEED CLERK OF COUNCIL DATE: APR 1 1 2019 �0 FIRST AD A-2018-156-01 THIS FIRST AMENDMENT to the above -referenced agreement is entered into on April 2, 2019, by and between HCl Environmental & Engineering Services ("Consultant"), and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California ("City"). RECITALS A, On October 23, 2017, the City submitted a Request for Proposal no. 17-129 ("RFP") seeking qualified Consultants to provide range cleaning services for the City. The Consultant submitted a timely proposal and was selected by the City to provide services related to the RVP. 13, On June 19, 2018, the City Council approved Agreement #A-2018-156 ("Agreement") for Consultant to provide services detailed in the scopes of work for indoor gun range cleaning and the circulation system filter services. The term of the Agreement continues through June 30, 2021, and the Agreement is current and in effect. C. The City contacted Consultant for a quote to provide ballistic water tante cleaning services. The ballistic water tank cleaning services were among those services detailed in the RFP and listed within Consultant's selected proposal. D. The parties now wish to amend the Agreement to include the scope of wort, for the ballistic water tank cleaning services. The additional work will not affect the total not -to -exceed amount provided in Section 2.a. of the Agreement. E. The parties also seek to amend the Agreement and incorporate the entire proposal submitted by the Consultant to allow the parties to accept any new quotes or proposals related to the services detailed in the proposal submitted by the Consultant during the term of the Agreement. The parties agree and understand that any increase to the not -to -exceed amount provided in. Election 2.a. of the Agreement is subject to an amendment requiring approval by the City Council. The Parties therefore agree: 1. Section 1, Scope of Services, is amended to reads it, Consultant shall perforin during the term of this Agreement, the tasks and obligations including till labor, materials, tools, equipment, and incidental customary work required to fully and adequately complete the services described and set forth in Exhibit A and Exhibit A-1. Exhibit A-1 shall be attached and incorporated by reference to the First Amendment to this Agreement. Contractor's proposal elated November 1, 2017, shall also be incorporated by reference as though fully set forth herein. Page t of 2 b. City shall contact Consultant to provide quotes for new or additional services, as detailed in Consultant's proposal, and provide written confirmation to Consultant to commence work. The parties agree and understand that any services which may increase the compensation section detailed in Section 2.b. of the Agreement is subject to approval by the City Council. 2. Except as modified by this First Amendment, all other terms and conditions of the Agreement shall remain in full force and effect.
