Except as otherwise provided by law, no action shall be taken on any item not listed on the agenda. Public Comments/Public Input - Pursuant to Government Code Sec. 54954.3, the public may address the Housing Authority and any other legislative body scheduled to meet on same day and time on any and all matters within the City of Santa Ana's jurisdiction. At the discretion of the Chair, at the first Public Comment portion of the meeting, all comments may be considered jointly. The public will be given the opportunity to speak on any and all matters contained on any of the Consent Calendar and Business Calendar items and/or on issues of public interest within the jurisdiction of the City. For public hearings, members of the public shall be given three (3) minutes for each duly noticed hearing (unless the matter is continued prior to taking public testimony). All requests to speak shall be submitted in writing to the Clerk of the Council at the beginning of the meeting and before Public Comments begin. Speaker forms will be available at the meeting. COMMUNITY REDEVELOPMENT AND HOUSING COMMISSION ACTION At its regular meeting on January 23, 2019, by a vote of 8:0, the Community Redevelopment and Housing Commission approved the recommended action. DISCUSSION The October 2018 — December 2018 Quarterly Report for the Housing Choice Voucher (HCV) Program provides statistics for the day-to-day activities of the Santa Ana Housing Authority. The report is divided into three sections: Applicants, Participants, and Production. Applicants The Santa Ana Housing Authority accepted applications from July 1, 2015 through July 30, 2015 and received a total of 16,375 applications. A random lottery procedure was used and the Santa Ana Housing Authority accepted 5,000 of the 16,375 applications to establish a 2015 HCV Waiting List. Charts 1 and 2 depict the characteristics of those currently on the Waiting List. As of December 2018 there are 2,905 applicants on the 2015 HCV Waiting List. Chart 1 illustrates the percentage of applicants on the 2015 HCV Waiting List who live or work in Santa Ana. These applicants are given a preference on the Waiting List together with U.S. Military Veterans. 3-1 1. The majority of applicants on the Waiting List consist of only one or two household members. Over half of all applicants (1,545 of the 2,905 applicants or 54%) have one or two member households and would qualify for a one -bedroom voucher. Sources of Income With any wages With any Welfare With anySSJSSI With any other income HQS Inspections: At least once every two years, the Housing Authority must inspect each assisted -unit to ensure it meets HUD's Housing Quality Standards (HQS) in compliance with the federal regulations. From Octoberto Decembera total of 287 inspections and re -inspections of our assisted -units were performed of which 93 inspections failed. In addition, when a participant's income changes, an interim examination must be performed. During the reporting period, a total of 937 recertifications and interims were conducted. Chart 8 illustrates the number of recertifications and interims performed. Participants' incomes come from a variety of sources, as illustrated in Chart 6. A total of 43% of participating families have income from employment. Participating families pay a portion of their monthly rent based upon their income and the payment standard for their unit. The Housing Authority pays the difference between the tenant's portion and the contract rent. This payment is the Housing Assistance Payment (HAP). The average HAP for October through December was $1,036. Production 7. COMMUNITY REDEVELOPMENT AND HOUSING COMMISSION RECOMMENDATION At its Regular Meeting on February 28, 2019, by a vote of 6:0 (Aguinaga, Garcia, and Urzua absent), the Community Redevelopment and Housing Commission approved the recommended action. DISCUSSION The United States Department of Housing and Urban Development (HUD) requires housing authorities that administer a Housing Choice Voucher (HCV) program to have an Annual Plan and HCV Program Administrative Plan. The purpose of the Housing Authority of the City of Santa Ana (SAHA) Annual Plan is to advise HUD, program participants, applicants, and members of the public on our policies, programs, operations, and strategies for meeting local housing needs and goals. The purpose of the HCV Administrative Plan is to establish policies for administering the Housing Choice Voucher Program in a manner consistent with HUD requirements, local goals, and objectives contained in SAHA's 5 -Year Plan and Annual Plan. The Annual Plan (Exhibit 1) provides detailed information about the current operations of the Santa Ana Housing Authority. As required by HUD, three Resident Advisory Board meetings were held on January 22, 2019 with approximately 22 residents who receive assistance from the housing authority. The three meetings were conducted in three languages: English, Spanish, 4-1 Public Hearing for Housing Authority Annual Plan March 19, 2019 Page 2 and Vietnamese. All active HCV Program participants were mailed an invitation to participate on the Resident Advisory Board and the Resident Advisory Board provided input for the development of the Annual Plan and adoption of the Resolution (Exhibit 2). Staff analyzed all of the recommendations from the Resident Advisory Board by: 1) considering the feasibility of each recommendation; 2) discussing as a team the opportunity for SAHA to implement each recommendation; and 3) making a determination on which recommendations) could be implemented or considered for future implementation. On February 2, 2019, a legal notice was published in the Orange County Register, and on February 5, 2019 in the Nguoi Viet and La Opinion newspapers advising the public that a draft of the Annual Plan was available for public review and comment and a public hearing would be held on March 19, 2019. HUD federal regulations require a 45 -day public comment period and the public comment period ends on March 19, 2019. All comments received will be included in the Annual Plan submitted to HUD. The 5 -Year and Annual PHA Plans provide a ready source for interested parties to locate basic PHA policies, rules, and requirements concerning the PHA's operations, programs, and services, and informs HUD, families served by the PHA, and members of the public of the PHA's mission, goals and objectives for serving the needs of low- income, very low- income, and extremely low- income families Applicability. Form HUD -50075 -HCV is to be completed annually by HCV -Only PHAS. PHAS that meet the definition of a Standard PHA, Troubled PHA, High Performer PHA, Small PHA, or Qualified PHA do not need to submit this form. Where applicable, separate Annual PHA Plan forms are available for each of these types of PHAs. Definitions. (1) High -Performer PHA — A PHA that owns or manages more than 550 combined public housing units and housing choice vouchers, and was designated as a high performer on both of the most recent Public Housing Assessment System (PHAS) and Section Eight Management Assessment Program (SEMAP) assessments if administering both programs, or PHAS if only administering public housing. (2) Small PHA - A PHA that is not designated as PHAS or SEMAP troubled, or at risk of being designated as troubled, that owns or manages less than 250 public housing units and any number of vouchers where the total combined units exceeds 550. (3) Housing Choice Voucher (HCI9 Only PHA - A PHA that administers more than 550 HCVs, was not designated as troubled in its most recent SEMAP assessment, and does not own or manage public housing. (4) Standard PHA - A PHA that owns or manages 250 or more public housing units and any number of vouchers where the total combined units exceeds 550, and that was designated as a standard performer in the most recent PHAS and SEMAP assessments. Apply for any new funding opportunities. • The Housing Authority of the City of Santa Ana (SAHA) received an award of 100 HUD -Veterans Affairs Supportive Housing Project - Based Vouchers (HUD-VASHPBVs) under PIHNotice 2017-17 and an additional award of 105 HUD-VASHtenant-based vouchers under PIHNotice2018-07. • Following the award of11UD-VASHPBVs under PIHNotice 2017-17, SAHA issued an RFP and committed the 100 HUD-VASHPBVs to three affordable housing projects including: 8 HUD-VASHPBVs committed to National CORE for the development of the Santa Ana United Methodist Church project which will include 93 total units of which 33 will be permanent supportive housing; 3 HUD-VASH PBVs committed to HomeAid Orange County for the development of the Frances Xavier project which will include Il units of permanent supportive housing; and 89 HUD-VASHPBVs committed to Jamboree Housing for the rehabilitation of the Budget Inn motel to create 89 permanent supportive housing units for qualified and eligible homeless veterans. • In September 2018, SAHA also received an award of 50 Mainstream Vouchers following a competitive application process under 2017 Mainstream Voucher Program NOFA FR -6100-N-43. Coal # 2: Improve the quality of assisted housing by improving voucher management, increasing customer satisfaction, and improving specific management functions. • Retain high performer SEMAP status: SAHA was certified as a High Performer for FFY2018. • Under SAHA's Quality Control Program, SAHA seeks to continually improve the quality of assisted housing by improving voucher management, increasing customer satisfaction, and improving specific management fractions. Specifically, for FFY2018 SAHA audited a total of 420 files under SEMAP Indicator # 3, even though the minimum sample size required by HUD was only 34 f les. For SEMAP Indicator # 5, SAHA audited a total of 84 inspections even though the minimum sample size required by HUD was only 32 quality control inspections. • Maintain leasing to 100% of HAP funding: SAHA utilized 102.0% of our Annual Budget Authority from HUD for CY2018. Goal # 3: Increase assisted housing choices, portability counseling to 100% of participants, conducting outreach to potential property owner. • Continue to mail owner/participant newsletters: Since December 2015, SAHA has been e -mailing a monthly electronic Landlord Newsletter to all owners. In October 2016, SAHA began sending a monthly electronic Housing Plus Program Newsletter (aka Family Self -Sufficiency Program) to our participants who have provided us with their e-mail addresses. • Implement annual customer satisfaction survey: No update Goal # 4: Promote self-sufficiency by increasing employment among participants, linking to supportive services to increase independence for the elderly and/or disabled, and increase participation in the Family Self Sufficiency (FSS) program. • Continue to provide referrals to the Santa Ana W/O/R/K Center for job training and placement services, providing information and linkages to the County's Council on Aging (elderly services) and the Dayle McIntosh Center (disabled services), and conducted recruitment for the FSS program at initial voucher issuance, at annual re-examinations, and through tenant newsletters: SAHA hired a full-time Workforce Specialist I /FSS Coordinator effective February 2, 2018. The Workforce Specialist I has been working to increase participation in the program through outreach and engagement while also providing monthly case management to participants in the program. The Workforce Specialist I is co -located in the Santa Ana WIOIRIK Center through a Memorandum of Understanding. SAHA also requires in any RFPs for project -based vouchers that a developer into an agreement with the Santa Ana Work Center. Goal # 5: Ensure equal opportunity and affirmatively further fair housing through coordination with the Orange County Fair Housing Council, the preparation of the Analysis of impediments to fair housing choice, and continued training on fair housing practices for staff owner's and participants. • Fair Housing programs and resources are included in all issuance briefings, reasonable accommodation tracking logs updated. Communication was maintained with the County's Fair Housing Council, Public Law Center, and Legal Aid, ensuring proper referrals for anyone alleging discrimination, whether an HCV participant or member of the public: In August 2018, SAHA held an annual Fair Housing Training for all Housing Division employees. This annual training is required for all employees. • Assist the City of Santa Ana in maintaining of the housing Stock: No update Goal # 6: Ensure assisted families obtain information, maintain housing and prevent domestic violence in accordance with Violence Against Women Act (VAWA) of 2005. • In accordance with the Violence against Women Reauthorization Act of 2013 (VAWA 2013), SAHA implemented an Emergency Transfer Plan for Victims of Domestic Violence, Dating Violence, Sexual Assault, or Stalking. • SAHA also implemented HUD -5380, Notice of Occupancy Rights under the Violence Against Women Act, HUD -5382, Certification of Domestic Violence, Dating Violence, Sexual Assault, or Stalking, and Alternate Documentation, and HUD -5383, Emergency Transfer Request for Certain Victims of Domestic Violence, Dating Violence, Sexual Assault, or Stalking. • SAHA coordinates with the County of Orange Domestic Violence office for referrals and to ensure applicants and participants are informed on all available services. • Information on VAWA in regards to owner/tenant responsibilities and evictions is provided to all program applicants and participants and also mailed to all owners. • SAHA's HCV Administrative Plan details restrictions on terminating assistance for victims of domestic violence, as well as guidelines on terminating assistance for perpetrators of domestic violence. • At a minimum, SAHA trains staff on VAWA at least once annually. Staff also proactively provides information on VAWA to any program participant or applicant who may show any evidence that information on VAWA is needed. Eligibility, Selection and Admissions Policies, including Deconcentration and Waiting List Procedures Recommendations: 1) Speed up the filtering process/review/approving process of housing applications. 2) People that are already on housing should not be able to apply for housing since they've already received housing assistance - should be filtered out at the onset. 3) Change the waiting list priorities. Priority should be given to senior citizens, disabled persons. 4) The waiting list should be open more often. d. Rent Determination Policies Give priority to single bedroom and two bedrooms in rent determination since those mainly serve senior citizens and disabled families. Approve rent at market value or at 98% of the fair market rent to combat the increased rent. Owner should accept housing because owners are still getting paid the same amount of rent regardless of where the money is coming from. e. Operation and Management Recommends: Annual meetings should be done quarterly. Monthly electronic Tenant Newsletter has potential to keep a tenant well informed & current. Can also provide information regarding Gosection8, Housing Choice Voucher program, portability program, listing of new units, new landlords, reminder regarding reporting changes. Inspections help because any maintenance issues can be addressed to the landlords f. Grievance Procedures Possibly giving more than 10 days if tenant needs to submit a grievance/request a review. Provide more information, more frequently, in more languages. Extend the 10 day to 30 days to file a grievance because the participant may be in the hospital or is mentally unstable. State the obligations and procedures in block letters and state the consequences if the participant fails. Provide counsel, suggestions, recommendations and list options available, consequences. Notification of consequences. MW EXHIBIT 1 Housing Plus Program Notify the housing tenants who have employments of the escrow account immediately. Notify housing tenants of regulations and policies governing withdrawals. SAHA to offer classes to educate tenants. This program is well designed to help the participant become independent. See this program as a stepping stone for those who qualify. To encourage others who would be interested in the HOME housing program, offer: Education conventions, expose to different careerpaths, different trade schools, provide information about short- term certificate programs at the Santa Ana Community College. What help can be given to a live -in -aide who is unemployed? Provide information to family members to participate in the Housing Plus program because family members may not know about the program. g. Progress in Meeting Mission and Goals Goal should be to provide affordable housing for working people and their families. The housing program mission can improve by extending the application from one month to three months. This area is in needs to assist the low-income population. Funds from the Federal Program should be extended to serve not only a certain number, but expand to those that qualify. SAHA move for improvement: to see clients one on one, on a case by case basis. h. Other Recommendations Not Listed Above Government shut down effects voucher for senior citizens and disabled families. Very important for the City Mayor and Council Members to take action for clients on Section 8. The program is working to assist people to become self-sufficient and securing a home which then would allow the participant to seek furthering their education. Provide legal advice. SAHA should provide tenants with consequences of the actions that they can take (for example notify by phone that not reporting changes on time will result in termination weekly or monthly). Housing Authority is also the last line of defense for owner rent increases. Other Recommendations Not Listed Above Nhdng ' Dien khac kliong co neu tren �i 1e� EXHIBIT 1 i EXHIBIT 2 RESOLUTION NO. 2019- A RESOLUTION OF THE HOUSING AUTHORITY OF THE CITY OF SANTA ANA APPROVING THE SUBMISSION OF THE ANNUAL PLAN FOR FISCAL YEAR 2019-2020 BE IT RESOLVED BY THE MEMBERS OF THE HOUSING AUTHORITY OF THE CITY OF SANTA ANA, AS FOLLOWS: Section 1. The Housing Authority of the City of Santa Ana conclusively finds, determines and declares as follows: A. The Housing Authority of the City of Santa Ana (the "Authority") is required by the U.S. Department of Housing and Urban Development ("HUD") to have an Annual Plan due to the fact that the Authority administers a Housing Choice Voucher ("HCV") Rental Assistance Program. B. The purpose of the Authority's Annual Plan is to advise HUD, program participants and members of the public of its mission and strategy to serve the needs of very low-income families. It provides information about the current operations of the Authority, including programs, participants, services for the upcoming year, and any operational or tenant concerns. C. The Authority is required to review its operations and needs for the Annual Plan with input from HCV participants. Three (3) Resident Advisory Board Meetings were held on January 22, 2019, with responses incorporated into the Annual Plan, as required by HUD regulations. D. HUD regulations require a forty-five (45) day comment period. On February 2, 2019, notification was published in the Orange County Register newspaper that the draft plan was available for public review. Additional notice of the public review period was also provided in the Nguoi Viet and La Opinion newspapers on February 5, 2019. The public comment period ended on March 19, 2019. Further, a public hearing was held by the Housing Authority on March 19, 2019, and all comments received at the hearing are included in the final documents to be submitted to HUD. Section 2. The Annual Plan for Fiscal Years 2019-2020 of the Housing Authority of the City of Santa Ana is hereby approved and adopted. Said Annual Plan shall be submitted by the Authority to HUD. Section 3. This Resolution shall take effect immediately upon its adoption by the Authority Board, and the Recording Secretary for the Authority shall attest to and certify the vote adopting this Resolution.
