Box 1988 Santa Ana, California 92702 www.santa-ana.org/pba NOTICE OF PUBLIC HEARING BEFORE THE SANTA ANA PLANNING COMMISSION The City of Santa Ana encourages the public to participate in the decision-making process. This notice is being sent to those who live or own property within 500 feet of the project site or who have expressed an interest in the proposed action. We encourage you to contact us prior to the Public Hearing if you have any questions. If you challenge the decision on the below matter, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the Planning Commission or City Council of the City of Santa Ana at, or prior to, the public hearing. Planning Commission Action: The Planning Commission will hold a Public Hearing to receive public testimony, and will take action on the item described below. Decision on the Site Plan Review and Addendum to the Environmental Impact Report decision is final unless appealed to the City Council within 10 days of the decision by any interested party or group. Recommendation on the Density Bonus Agreement matter will be forwarded to City Council for final determination. Location: 114 East Fifth Street and 117 East Fifth Street in the Transit Zoning Code (Specific Development No. 84), Downtown sub-zone Proposed Project: The applicant, Toll Brothers Apartment Living, is proposing to demolish an existing building and parking lot located at 114 East Fifth Street, and remove a surface parking lot located at 117 East Fifth Street in order to construct a mixed-use development project consisting of 220 rental units and 12,350 square feet of commercial space on a total of 2.78 acres. In order to facilitate the project, the applicant is requesting approval of (1) Site Plan Review No. 2019-01 and (2) Density Bonus Agreement No. 2019-01. In addition, the applicant is requesting approval and adoption of an addendum to the Environment Impact Report (EIR) for the Transit Zoning Code Project (SCH NO. 2006071100) and re-adoption of a mitigation monitoring and reporting program. Environmental Impact: In accordance with the California Environmental Quality Act (CEQA), the Planning Commission of the City of Santa Ana hereby finds, determines, and declares that based on the substantial evidence set forth in the record, including but not limited to the 2010 EIR and the 2019 Addendum, an addendum is the appropriate document for disclosing the changes to the subject properties, and that none of the conditions identified in Public Resources Code section 21166 and State CEQA Guidelines section 15162 requiring subsequent environmental review have occurred. Meeting Details: This matter will be heard on Monday, September 23, 2019 at 5:30 p.m. in the City Council Chambers, 22 Civic Center Plaza, Santa Ana, California 92701. All persons interested in this matter are notified to appear at this time.
