■ The appeal requests that the City Council reconsider the
Planning Commission's decision based on:

conditional use permits set forth in SAMC Section 41-638
The Commission erroneously determined that the project was
categorically exempt from CEQA as an infill development project
Amendment to Variance No. 2018-10 should have been denied
because it does not address "special circumstances"
The notice for the September 9, 2019 Planning Commission public
hearing was not reasonably calculated

The Commission failed to satisfy the 5 required criteria for
granting conditional use permits set forth in SAMC Section 41-638
The required findings for Conditional Use Permit No. 2019-30 were
made by the Planning Commission
The car wash will replace the existing automated car wash at 325
North Tustin Ave.

exempt from CEQA as an infill development project

accordance with the CEQA Guidelines Section 15332, Class 32 (In -fill
Development Projects)

Site is less than 5 acres and surrounded by urban uses
Previously developed site and has no habitat for endangered, rare or threatened
species

The project will not have a significant effect related to traffic, noise, air quality
or water quality as determined by the traffic study, noise study, compliance with
SCAQMD regulations and Conceptual WQMP

Construction or Conversion of Small Structures)
Development less than 10,000 square feet
Does not involves use of hazardous substances
