Call for review and appeal of the Planning
Commission decision regarding CUP No. 2019-
10 and CUP No. 2019-11
Initiated at the regular City Council meeting of
October 15, 2019 by Councilmember Penaloza
in accordance with Sections 41-642 and 41-
645 of the SAMC
The City Council after discussing the matter has
the following options:
If the council is dissatisfied with the action of the Planning
Commission or is of the opinion that the matter is of such
magnitude as to be of special interest to the people of the City it
may, by majority vote, set a public hearing to consider
modification of the Planning Commission action regarding this
matter. The meeting is to be held at a regular or adjourned
meeting with public notification made by the Planning
Department as was required for the initial hearing; or
Take no further action, in which case the Planning Commission
approval stands.
Upgrade existing Type 41 (beer & wine) to
Type 47 ABC license to allow distilled spirits
sales
Proposed 600 s.f. expansion
After hours operations
1) Approved CUP No. 2019-10 with added
conditions:
Replace storefront with noise proof storefront
Planning Commission review in six months
2) Continued CUP No. 2019-11 for after
hours operations to April 27, 2020
Prior public hearing held on April 22, 2019
Item continued to allowing time for staff, applicant
and community to meet and discuss issues
Two community meetings were held
Police inspection in mid -September
Calls for service updated
Calls for service in the past five year:
Twenty-four calls for service at this address
Five calls resulted in actual reports
(Fight w/injury, minor fight, noise, stolen vehicle and armed robbery).

The CUP will allow for the sale of beer, wine and distilled spirits
as a complement to patrons' meals within a bona -fide eating
establishment
Site meets all standards of the SAMC
No active code enforcement actions

The Police Department does not oppose granting the CUP due
to minimal crime related activity
