The permits requested will result in a parking crisis,the increased noise will create social environmental, and public health problems. Residents are greatly concerned about the safety and security of our neighborhood/s. Directly on the back side of Mariscos Hectors are houses and a densely populated neighborhood. The quality of life in the neighborhoods impacted will deteriorate. We support Mariscos Hectors to continue under its current permits. We need more family style restaurants that are located inside neighborhoods to serve only beer and wine, and to close at reasonable hours when working families and children go to bed. The first two meetings were cordial and seemed to be productive. Today's meeting at city hall, which included planning manager, was very unproductive. The neighborhood representatives clearly stated that no matter what we did including offers of goodwill that they were going to oppose Mariscos Hectors on anything we did. They stated that their issues were parking, noise, and security. Our parking and security plans have successfully been in place for months and the noise issue will be solved when soundproof windows and doors are installed. All the neighbors surrounding the Restaurant location are in support of Mariscos Hectors Below are statements from your staff report that offer bottom -line reasons for you to support this application. My application has been in compliance with the entire city's request. I have been working On this liquor license application with the city of Santa Ana for over two years. Thank you and I ask you to support my application. Maria Sebold CONCLUSION Based on the analysis provided within this report, staff has determined that the proposed project is in compliance with the City's operational standards for uses with alcoholic beverages. Further, the project site has no open code enforcement violations and is compliant with State ABC regulations. The Police Department has analyzed crime statistics for the site for the past year and did not identify any issues with the restaurant. Finally, staff and the applicant have met with the community on two occasions to understand and address their concerns STRATEGIC PLAN ALIGNMENT Approval of this item supports the City' s efforts to meet Goal No. 3 ( Economic Development) Objective No. 2 of creating new opportunities for business/job growth and encourage private development through new General Plan and Zoning Ordinance policies. FISCAL IMPACT The project will generate additional sales tax revenue, increase the number of permanentjobs and will provide additional dining options for the community. In addition, the expansion of the restaurant into an adjacent and vacant tenant space will require that permit and inspection fees be paid to the City. It is estimated that a slight increase in sales volume will occur from the enlarged restaurant with additional seating areas and from the sales of distilled spirits. The first step was to wire brush the entire parking lot with a bobcat tractor with a power wire brush to remove the over 5 layer of asphalt slurry. On the 18`h of July the contractor started at 6 am blowing dust and making noise. I called the Santa Ana police with a dust and noise complaint,ln unit to arrive at 6:33 am, Officer Holcomb confirmed that Santa Ana has a 8 am start time and contractor could start work at that time. When asked about my dust complaint the officer said "we don't do anything about dust". Officer left parking lot at 6:55 am. At 7:02 1 called the South Coast Air Quality Management District (AQMD). Complaint # 300543 The Inspector arrive at 2500 n Bristol at 7:30 am (what happen to a 8:00 am start time?) and observed the dust and informed the contractor to use better dust control on site. At 8:20 am I was on phone with Inspector with her telling me that the contractor was told to watch his dust and had turned down equipment that was blowing asphalt dust. I informed her that I was looking at the parking lot and it looked like they were blowing a lot of asphalt dust and the dust plume was over 20 ft high. Over the next 4 days I spoke with several different people with the city and county fire department to no avail. We even had the big fire truck out 2 times to look at the asphalt dust on Sharon Rd. Monday 22 JULY Clean up Contractor was informed by Craig Foster of Santa Ana public works to clean up the 1300 block of Sharon rd . Contractor used a HEPA vacuum to clean right of way. Was suggested by the city that I work with Scott Kutner, Senior community Planner, on trying to fix and understand what went wrong. I also sent a sample of the asphalt dust to EMSL ANALYTICAL inc the result were 34.7% Crystalline, Silica and 2.1 % Cristobalite Silica over 36 times the amount allow by Cal OSHA on a job site. Oct. 28 thru 31 Church decided to mill X inch off the asphalt and slurry to get to solid asphalt using water as dust control.. I did not observe the work that day. On the 291h I did observe dust crossing the walls on the back yard of the 2500 block of Poplar St. I called AQMD to file a complaint #305111 30`h More dust observed crossing walls of the back yard of the Poplar homes. Called AQMD have yet to hear from them. 31 new contractor was cleaning cracks and sealing them, creating lot of dust in the cleaning of cracks. Scott Kutner inform me that the city code enforcement was shutting the job site down for no permit or business License.) was told they could not work till they had The city license and permits Sat. Nov 2 A sub contractor came in and washed the parking lot of the asphalt milling, letting the milling go into the gutter on 1300 block of Sharon Rd then 2500 block of poplar, traveling down to 1400 to 1500 River LN into the storm drain and Santiago Creek. Monday Nov 4th Received a call from neighbor asking about all the black mud laying in gutter of Sharon and Poplar Rd. I went to the Church parking lot and found two contractor employees blowing the dirt and dust over the wall again and it was before 8 am. I ask them to stop and said I thought the job was shut down by the city. Craig Foster of public works showed up and the workers were blowing dust again. Craig went to the Church to talk to them. About a hour later I was talking to Catalina Garibay-Vegas at her home on Poplar and dust was crossing over her wall. I asked Craig to shut them down again. Later I went to the church parking lot to meet with Code Enforcement Officer, Toni Carvalho seeing that they were blowing asphalt dust with Toni watching them. I asked her why they were blowing dust on a job that was shut down. She said she wanted to see what the problem was with the dust going over the walls. Less than 30 seconds later the dust was going over the wall. I called the AQMD and left a message about the dust. No response from AQMD That after noon the Contractor was starting to clean up the mud and dirt on our streets Nov 5T" Contractor is pressure washing the curb and gutter and using sand bags to capture the asphalt milling.
