This License and Right of Entry Agreement is entered into on the date referenced below by the City of
Santa Ana, a charter city and municipal corporation duly organized and existing under the Constitution
and laws of the State of California ("City"), and Rocio R. and Guadalupe R. Lopez, owner ("Owner") of
the real property located at 320 E. Pomona Street, in the City of Santa Ana, County of Orange, APN No.
403-183-05 ("Property"), as depicted on Exhibit A. In consideration of the benefits accruing to Owner
under this Agreement, Owner hereby grants to City the right to enter the Property and a license for the
following purposes:
Construction of improvements, including without limitation sewer lateral slope
adjustment, in conjunction with Capital Improvement Project No. 17-6437 for
Citywide Sewer Main Improvements
City agrees to indemnify and hold harmless Owner from any liability arising out of City's exercise of
this License and Right of Entry Agreement. City further agrees to repair any damage to the Property
caused by the exercise of this License and Right of Entry at City's sole cost and expense, and to restore
the Property, with the exception of the improvements left thereon, as nearly as practicable to the state in
which it existed prior to the use of the Property by City.
The rights herein granted to the City are exclusive, and the City agrees not to assign, transfer, lease,
pledge, or otherwise dispose of its License and Right of Entry without the prior express written approval
of Owner. No right of entry to existing buildings is conveyed by this instrument.
This License and Right of Entry shall expire upon completion of the work that is the subject of this
Agreement, and in any event, no later than December 31, 2019, unless extended by written agreement
between Owner and City.
