As a result of this grant, the OCDA conducted a county- wide inventory of sexual assault kits (SAKs) in order to determine which SAKs were tested and which were untested. Through this process, the OCDA found that approximately 3700 SAKs were untested. The next step in this SAKI grant is to test all previously untested SAKs. While the OCDA intends to send some of the untested SAKs to the OCCL for testing, a large number of the SAKs, that meet certain pre -determined criteria, will be sent to Bode Cellmark, Inc., a fully accredited private DNA laboratory. The purpose in sending these SAKs to a private laboratory is to get the untested SAKs tested sooner. The criteria the OCDA is looking at to determine which SAKs will be sent to the private laboratory are: 1) no consensual partners, and 2) low likelihood for filing criminal charges even with DNA testing. This Letter of Agreement serves as notice of and an agreement between the OCDA and SAPID, that: 1) SAPID is aware of the above -stated goal to test these previously untested SAKs as quickly as possible, 2) SAPID understands that, in order to achieve this goal, the OCDA may send SAKs that meet the above -listed criteria to an accredited private DNA laboratory, and 3) SAPD acknowledges that if SAPID has untested SAKs that meet the above -listed criteria, those SAKs could be included in the SAKs that are sent out to the private DNA laboratory for testing. This Letter of Agreement does not apply to or change any Standard Operating Procedure for the testing of SAKs in current sexual assault cases.
