do we expect to lessen the number of confirmed Covid-19 cases in Santa Ana when a lot of people live in
crowded homes due to housing units being too expensive? How do we expect to lessen the number of people
losing their homes and becoming homeless when we dont offer the support needed to prevent this in the first
place? We need real solutions that actually support and care for the community. Santa Ana NEEDS REAL
PERMANENT RENT CONTROL NOW!

I am a life-long resident of Santa Ana and currently reside in ward 2. I am addressing you today in preparation
for tomorrow's city council meeting. I am asking for your attention on several agenda items. Your attention is
urgent and I ask that you please consider these concerns regarding the following:
Item 8513: In support of Item 85B, we are asking for an extension on signature gathering for rent control in
Santa Ana. As a proponent of rent control, I feel that we must see this petition through for a vote on the ballot.
Due to the pandemic, organizers have lost 133 of the 180 days we were legally entitled to gather signatures. I
urge you to grant an extension for signatures during this crucial time when many are receiving abusive rent
increases. We need protections now more than ever with real and permanent rent control in our city.
Item 25A (and closed item 3): I urge you to REJECT the purchase and sale agreement of 203- 204 W. Civic
Center Dr. It's a disgrace to see how a gentrifiers' money has been sent to City Council with intent to garner
support for business over the needs of our community. Keep community land in community hands! The citizens
of Santa Ana have continually suffered due to gentrification efforts that have only displaced individuals and
families. We would like to see the land be utilized for community development and efforts that directly benefit
the residents- instead of displacing and extracting resources from the community. This community does not
benefit from a boutique hotel or any other business model that does not directly fulfill the needs of the
community. Let's collectively create spaces and resources for the underserved (including our youth).
Item 2213: I urge you to REJECT the purchase order for a "Specialized Response Vehicle" that further instills
fear and perpetuates a divide between the community and the authoritarian tactics of the police force. This
infringes on the people's right to assemble and demand progress. Members of the community are simply asking
for our voices to be heard and our needs to be met, yet the city's funds are perpetually supporting fear tactics
and absurdly expensive vehicles and equipment for COPS. STOP supporting the violent and aggressive police
presence in our community. Utilize the city's funds to actually aid the people and benefit marginalized groups
instead of policing and dividing us.
Item 25E: I urge you to REJECT the requested increase in funds for parking enforcement services. Residents
are continually facing obstacles with parking, especially since the pandemic. Many of us are now home during
the day in households that do not provide adequate parking for the number of vehicles per household. Enforcing
parking and creating more challenges for us when we need to shop or park in areas outside of our residence
hinders movement and flow within our city. The constant policing and funneling of our hard earned wages
makes it nearly impossible to thrive in a city that BELONGS TO THE PEOPLE, not to the systems that profit
from our hardships.
Lastly, I have continually observed police officers (sheriffs, deputies, and highway patrol) responding to
incidents and pulling people over WITHOUT MASKS ON. I live at a busy intersection and in the past several
days I've seen a response to a traffic accident and a few drivers being pulled over by cops who are not wearing
protective coverings. THIS IS NOT OK during a pandemic in a city that has one of the highest number of
COVID-19 cases in the county. This continues to make citizens feel unsafe in the presence of police officers
and I urge you to address this concern for our community.

INITIATIVE ON THE BALLOT
Dear Mayor Pulido and City Council members,
We are reaching out to ask that you please support an extension of the signature
collection period and place the rent control initiative on the ballot. Tenants United
Santa Ana in previous campaigns (2018 and present) has shown massive public
interest in a rent control ordinance for Santa Ana.
On Tuesday, August 18, the City Council will be deciding whether or not to give
petition circulators an extension (Agenda item 85B). We know that in other cities,
petitioners have been granted an extension because the shelter -in -place orders
prohibited signature gathering, causing petitioners to lose days they were legally
entitled to in the democratic process.
We urge you to grant the extension and support placing the rent control initiative on
the ballot.

The group, Tenants United, admitted that they had failed to gather the required signature to put a "rent control' initiative
on the ballot.
After consulting with their unknown higher ups, they now feel victimized and are blaming their inability to get the required
signatures on others.
If the rental market stays strong, which is unlikely, they can continue to gather signatures for some future elections, but for
now, they need to accept the reality that they have missed it for this election.

Dear City Council and particularly, Mr. Sarmiento,
Thank you for considering this item. It is not solely about rent control, but the voter initiative process which is a
coveted process of governance worldwide. The pandemic continues to affect everything. Utilizing city
resources to ensure that the people have a fair chance to collect signatures which is a right under law, is an
excellent item for the council to consider.
As of 11:28 am on August 18th, there is a person named Mark Allen who submitted an ecomment against
utilizing city resources for ensuring a democratic process can take place in spite of the pandemic. This person
calls themself a "Small Rental Property Owner in Santa Ana". This person is attacking the initiative of rent
control which lost 133 days out of the mandated 180 days of signature gathering for the initiative. The person
offers that Tenants United Santa Ana consulted with "unknown higher ups" in an attempt to discredit the
coalition of residents and organizations in Santa Ana easily amounting to over one thousand people who also
have support of other organizations both statewide and nationwide. Tenants United Santa Ana, since the
pandemic began, has been offering tenants and landlords assistance in navigating non-payment of rent and anti-
eviction ordinances. This has resulted in stabilized communities as well as reduced spread of COVID-19 in
Santa Ana. Meanwhile, this "Small Rental Property Owner", who may not even live in Santa Ana currently, has
not proven that they have contributed to Santa Ana's continued success as a City where the majority of residents
are renters, low-income, and of color. I invite the Council to give more weight to the residents who actually
live, work, and contribute on a daily basis to Santa Ana's beauty and success as a City.
Any effective rent control initiative and ordinance works to the benefit of both renters and small mom-and-pop
landlords such as the individual mentioned above. Without rent control, big outside developers and money flood
into the city causing property taxes to increase at unaffordable rates for all non-corporate entities. The cost of
living increases for all who have lived in the City for decades while wages remain stagnant. More and more
families have to cramp into units which increases density while newly constructed residences sit vacant.
But that is not what this agenda item is about. This agenda item is about ensuring that the democratic process of
signature gathering is able to receive relief just like many other aspects of our world - individuals, businesses,
etc. - have been able to receive as a result of the pandemic. I urge the Council to uphold this democratic right
and utilize any and all City resources to allow for extensions on initiative efforts which were halted as a result
of the pandemic. Besides the Sangiacomo case, there have been many other court rulings around the nation
which have granted extensions to signature gathering efforts which were halted because of the pandemic.

Dear City Council,
In many other cities, courts have ruled in favor of petitioners, understanding that the shelter-in-place orders
explicitly prohibited them from gathering signatures, causing them to lose days they were legally entitled to in
the democratic process.
As a volunteer for Tú Santa Ana, we request that the city council consider extending the deadline to account for
the 133 days we could not safely gather signatures during the shelter-in-place orders.
Alternatively, we ask that the city council place the ordinance on the ballot -- putting the question to voters and
honoring the fact that we have demonstrated public interest both in 2018 and now.
Directly placing the ordinance on the ballot would most effectively address the impending eviction and housing
instability crisis. As many people are rent burdened, and putting their lives at risk to work through this
pandemic as essential workers, please know that real safety from renters’ protections. This pandemic has
without doubt worsened from lack of renters' protections, forcing people to have to go into work to make ends
meet, risking the lives of themselves and their loved ones.

As you are all aware, the majority of residents in Santa Ana are renters and experience extreme
burdens in rent. These very same folks experience ridiculous rent increases that make it impossible to
keep up with rent. For these reasons, rent control is very much needed in this city. We cannot expect
people to meet rent, experience rent increases, and simultaneously meet other basic needs (e.g., food).
No one should have to choose between being housed and food. This pandemic has only heightened
the precarity in housing for many residents in Santa Ana. Many have been financially impacted by the
pandemic, leaving them unable to pay rent, let alone catch up with rent increases. Family members of
my own who battled the virus were more worried about finances than their very own well-being and
health. This is absolutely cruel. You have the power to change this by supporting the extension of the
rent control campaign. Rent control would alleviate financial insecurity.
The rent control campaign started in February 2020 by collecting signatures for our rent control
petition. Over the next few months, we garnered extensive support from our community members
including renters and homeowners. But unfortunately, due to the global pandemic, we lost 133 days of
signature gathering out of the 180 days we were legally entitled to gather enough signatures to put
rent control on the ballot for Santa Ana. The shelter-in-place orders explicitly prohibited us from
being able to go door-to-door, but we have demonstrated massive public interest in our campaign.

The drastic transmission of COVID-19 has most noticeably impacted low income communities of
color, small businesses, undocumented people, and workers in the service and hospitality
sector.
Metropolitan areas with significant residential density and poor safety measures are prone to
outbreak. In Orange County, Santa Ana ranks high on the list of overcrowded living conditions.
The average population density per square mile in Santa Ana (12,188) is three times higher than
91.2 1. The overcrowded living conditions in Santa Ana are
not voluntary but imposed on residents through rising rents and displacement. This directly
prevents people from practicing social distancing or quarantining during health crises. We know
Santa Ana has the highest count of COVID-19 cases in Orange County 2, therefore the shelter-in-
place orders have been both difficult and yet a crucial part of lowering the risk in our city.

understand the importance of addressing rent stabilization in our city, recognizing that the
majority of residents are renters (56%) and are rent burdened (64%). Beginning on February
1st, 2020, we kicked off the Rent Stabilization Ordinance (RSO) campaign. The spread of COVID-
19 spiraled into a global pandemic soon after we began our campaign. While we have all
transitioned to online interfaces to accommodate our lives, the RSO campaign relies upon
physical interactions for collecting signatures, none of which could be collected via internet or
phone call. For the safety of our families and communities, TUSA halted outdoor canvassing on
March 16th, due to the nationwide call limiting social gatherings.
In the period of 44 days before the shelter-in-place orders took effect, we trained 153
volunteers, and started circulating 153 petitions containing 50 signature spaces each. We have
confirmed that -

in-place order explicitly prohibited us from being able to go door-to-door, but within our brief
window of campaigning we demonstrated massive public interest in our campaign. Similarly, in
2018, we garnered substantial public support for our campaign -- we needed 9,854 signatures
and we ended up collecting 9,299 signatures. If given the full 180 days this time, we believe we
could have met the goal of gathering 10,909 signatures.
Due to the global pandemic, we lost 133 days of signature gathering out of the 180 days we
were granted. Since the nationwide call limiting gatherings of more than 10 people (March
16th) to our final date to turn in our signatures (July 27th), our ability to gather signatures has
been impacted. June 11, we began to have drive-up signature gathering events because the
shelter-in-place orders started to relax, but we still could not go door-to-door, residents who
were sick could not attend, and volunteers who were immunocompromised could not
participate. On July 2nd, one of our drive-up locations had to shut down because of a positive
COVID-19 case -- this method has proven to be risky and impractical as many of our volunteers
are elderly.
In San Benito County, the courts ruled in favor of petitioners who were circulating a petition
against an ordinance that the city aimed to pass.3 The courts stated that the petitioners should
have that opportunity and understood that the shelter-in-place orders prevented the
constitutional requirements from being met. This order granted the petitioners an extension
which would begin 30-days after the shelter-in-place orders were lifted.
We request that the city council consider extending the deadline to account for the 133 days
we could not safely gather signatures during the shelter-in-place orders. Alternatively, we ask
that the city council place the ordinance on the ballot -- putting the question to voters and
honoring the fact that we have demonstrated public interest. It is clear that this pandemic has
impeded our capacity to engage in the democratic process. Directly placing the ordinance on
the ballot would most effectively address the impending eviction and housing instability crisis.

On behalf of Western Manufactured Housing Communities Association and the 29 mobile home park
owners in Santa Ana, we are opposed to the effort to illegally extend the petition circulation period for
the rent control initiative.
The extension request isn’t needed. The petitioners have missed the deadline for the November 2020
election. Even if an extension is granted, the initiative would be placed on the March or November
2022 ballot. The petitioners have plenty of time to legally qualify for the 2022 election without the
interference of an impartial city or the courts. They also have other remedies, such as petitioning the
courts themselves, instead of insisting the city act on their behalf and thus transferring the legal
liabilities on to all Santa Ana Taxpayers.
There is no urgency for the city to act. Due to the eviction moratorium, no Santa Ana resident has
been evicted for nearly six months. In addition to the moratoriums, AB 1482, statewide rent control for
most apartments in California, was signed into law last year. This law limits rent increases to CPI plus
5%. Currently, no one is being issued staggering increases and or being evicted from their
apartments in California, much less Santa Ana.
Enacting an extension is legally uncertain. The unopposed case sited by Council Member Sarmiento
is subjective at best. The Court extended the petitioners a longer time frame but only until the end of
September. In Santa Ana the petitioners are asking for an extension until January 11, 2021 (133 days
from the next Santa Ana City Council Meeting, September 1, 2020).
Election codes have certainties for good reason—to give both sides of an election fair boundaries and
requirements. They are communicated well in advance to promote unbiased fairness. To subjectively
change established rules is inherently unfair and biased. It is worth noting that two different groups in
Santa Ana recently were able to meet the high standards for citizen input on their issues with a recall
election and referendum on a development matter. Those groups were able to comply without the
help of the city putting their finger on the scale to help their cause.
This request is unjust and places the city in legal peril. The petitioners aren’t without other options.
They should exhaust those before asking the city council to champion their unpopular cause.

My apologies for the connection issues during the call in phase of the meeting. I attempted to call back in but
the call in line has been locked. Please work with staff to ID the technical issue so that our residents are able to

Though this email will reach you after the decisions have been made, I still wanted to share my thoughts and
observations on the following items.
20A - I'm supportive of this, thank you for bringing back the book mobile. We need to do everything we can
increase literacy access in our community.
22B - I do not believe that this item will provide any additional value to our city. I recommend that the Council
and Mayor ask the Police Chief if we have enough hazmat suits, decontamination units, mobile testing facilities,
and other emergency response materials. As the pandemic has shown us, we have had to scramble for basic
supplies to fight an ongoing biological threat. We should spend our federal grant funds on other supplies that
add to our ability to save lives in case of the unspeakable.
25A - I understand that the expense of restoring a historic structure like the YMCA will be substantial and that
it will be beneficial to get the property restored and back on the property tax rolls before a disaster like the one
that occured on Santa Ana blvd a few months ago.
However my concern is regarding whether or not the purchaser will be able to honor the timeline being
described here. As it stands there are 4 other major projects that they are involved with but have shown little
progress. I would recommend that the City proactively seek out alternative bids if Caribou Industries is unable
to uphold its obligations under the terms of the sales agreement.
25D - Maybe this is the most innovative cost-effective program available but I’m seeing red flags. Why did the
staff report just copy and paste the promotional material from the America on Track website? There was a
sentence where the staff report just changes the point of view from first person to third person. The drug
program descriptions on the organization's website referred to were from a controversial 'weed and seed'
program. This program was studied and found to be ineffective and counterproductive according to a 2005

Our contracting decisions should be guided by the idea that the City can use these types of smaller contract
opportunities to grow local institutions. Are we really saying that in the nonprofit center of Orange County we
were not able to find any local organizations with an ongoing presence that would be able to tell kids that drugs
are bad?
55C - Thank you and the Public Works team for their efforts on expanding these safe routes to school. We need
to continue the City's efforts to emphasize safety in all aspects of our transportation network.

75B - I'm in opposition to the revision of the Housing Opportunity Ordinance as it is written. My understanding
of the proposals indicate that these revisions will remove the applicability of an affordable housing requirement
for all development projects within existing specific plans, specific developments, and overlay zones.
If this is the wish of the council, then you should be able to publicly defend the idea that the Main Place
Specific Plan should not include nor financially contribute to the affordable housing fund. That will be the
direct result of your decision.
85B - I'm supportive of the idea of granting an extension for the collection of signatures. The
unusual circumstances around the coronavirus pandemic significantly delayed the collection of signatures. If
only because this extension would further encourage the participation of residents in the democratic process. I
realize that this is not a proposal that the members of the Council are supportive of, but I hope that your faith in
the democratic process outweighs your reservation of the specifics of the proposal that is gathering
signatures.

The group that is called, “Tenants United,“ tried to get enough signatures to put a rent control initiative on the
ballot for this fall, but they failed to get the signatures in time. After consulting with their unknown connections
with the city, they now feel victimized and are blaming their inability to get the required signatures on others.
They can continue to gather signatures for some future elections, but for now, they need to accept the reality
that they have missed it for this election.

Dear Mayor, City Council Members and City Manager,
I’m a long time apartment owner and manager who grew up in Santa Ana and went to Santa Ana High School.
It has come to my attention that the city counsel is being requested to extent the petition drive window for a
Rent Control ballet. Please don’t extend the petition signature period.
The way I see it is there are two kinds of apartment owners: mom and pop owners who generally charge 5%
under market and raise rents 1-3% per year like clock work and corporate apartment owners who push rent
increases and defer maintenance. If Santa Ana votes in stringent rent controls the mom and pop owners will
simply sell. I will most probably sell all three of my Santa Ana apartment buildings and buy elsewhere.
In closing we have a beautiful well run city and I hope you keep it that way.
