HomeMy WebLinkAboutCorrespondence - Non-Agenda April 19, 2021 Mayor and City Council City of Santa Ana 20 Civic Center Plaza Santa Ana, CA 92701 RE: Code of Conduct for Electrical Corporations Relative to Community Choice Aggregation Programs Dear Council Members, As Community Choice -s consideration, formation, and implementation of CCA programs. The rules are intended to provide fair and equal competition for CCA programs, prevent IOUs from using their position or market power to undermine the development or operation of community choice aggregators, and assist customers by enhancing their ability to make educated choices among electric providers. To further such interests, it is imperative to provide public officials and decision makers with some of the relative rules governing Recently, SCE representatives have been approaching cities considering CCA. SCE has given cities presentation material on CCA programs, been slotted to speak as CCA experts, and directly provided opinions on CCA to public officials. Although SCE states the Code of Conduct rules that prohibit IOUs from marketing and lobbying against CCA programs, simply stating the rules is not indicative that are alarming and potentially run contrary to code of conduct. Senate Bill (SB) 790 rules to govern the conduct of electrical corporations relative to the consideration, formation, and implementation of CCA programs. Pursuant to SB 790, the code of conduct rules are meant to facilitate the development of CCA programs, to foster fair competition, and to protect against cross-subsidization paid by ratepayers. Further, the bill required the code of conduct to ensure an electrical corporation does not market against a CCA program. 1 t: A. Prohibition on IOUs from marketing or lobbying against CCA programs, except 1 through an independent marketing division. An IOU cannot market or lobby against CCA program unless through an independent -E to the Commission, SCE stated it had no intent to form an IMD. Therefore, SCE cannot market or lobby against CCA programs. B. Prohibition on IOUs from speaking on behalf of any CCA program, giving any appearance of speaking on behalf of any CCA program, or making any untrue or 2 misleading . It is concerning that such interactions are taking place and we urge you to consider the policy behind such rules when exploring the potential benefits of community choice aggregation. Lastly, existing CCA programs are valuable resources of collective knowledge for interested municipalities. We encourage you or your staff to reach out to nearby CCA programs for information, such as Orange County Power Authorityief Executive Officer, Brian Probolsky at brian@ocpower.org, or the many other CCA programs throughout California. Fossil fuels are the number one driver of the climate crisis and if the world is to have any hope of a livable future fossil fuels need to be phased out. The climate crisis possibly is the biggest threat humanity has ever faced and definitely the biggest threat to human rights in this century. The truth is, fossil fuel expansion is undercutting any other work done on climate action and public health and safety, locking in decades of reliance on fuels dangerous to Santa Ana and the planet. We need to treat this like the emergency it is and put in place protections for all Santa Ana residents. Fossil fuels don't just exacerbate climate change, but also poison people. Study after study has shown that extracting, transporting, refining, and burning fossil fuels harms environmental and human health – and new evidence shows that toxic air pollution from fossil fuels also makes people more vulnerable to poor outcomes from COVID. We must phase out fossil fuels from our daily lives – whether it’s gas stoves causing asthma, tailpipes blanketing our streets with smog, or gas stations poisoning water supplies and spreading cancerous chemicals like benzene, it’s clear we must start moving to clean energy systems. But it's not just fossil fuels that are harming our community. Many neighborhoods in Santa Ana suffer from disproportionately high levels of lead in their soil, which can lead to serious developmental and health issues. The city must do more and protect our residents. Addressing these issues won't just improve our health, it will also improve our local economy. The Biden administration is investing money in green infrastructure buildout, and we need to make we have shovel ready jobs prepared. What's more, cleaning up environmental pollution and converting our energy systems are massive job opportunities that could bring family-wage jobs to thousands of people in Santa Ana I’m writing to you today to ask you to please pass the climate and public health emergency resolution that calls for an end to fossil fuel expansion, clean renewable energy choices that save money, actions that will reduce lead and other environmental toxins in our neighborhoods, family-wage jobs, and an endorsement of the Fossil Fuel Non-Proliferation Treart initative.
